It is hereby declared and found that a serious condition of traffic congestion exists on the streets and highways within the business and industrial districts of the Village; that such congestion is aggravated by the stopping of vehicles at the curbs of the streets and highways of the Village for the purpose of making deliveries to and from premises abutting thereon; that in certain areas of the Village such premises also abut on public parking places maintained by the Village and that in such cases it is reasonable to prohibit the stopping and parking of vehicles in the streets and highways for the purpose of making such deliveries and to require in such cases that such deliveries be made at the rear or other portion of such premises abutting on such public parking places; that the public safety and general welfare of the inhabitants of the Village will be promoted for such prohibition and requirement; and that in cases where structural alterations must be made to accommodate such deliveries at points other than those at which such deliveries presently can be made, a reasonable time for the making of such alterations is 90 days.
Whenever, in any area within the Village now or hereafter designated as a business or industrial district on the Official Map of the Village of Hempstead (zoning), a parcel of land abutting a street or highway shall also abut at any point thereof a public parking place or any portion thereof or any approach thereto maintained by the Village in such manner that vehicles may be stopped or parked therein for the purpose of making delivery of merchandise or other things to or from such parcel of land or any structure thereon, it shall be unlawful for any person to stop or park or cause to be stopped or parked any vehicle alongside the curb of any street or highway for any period of time for the purpose of making delivery of merchandise or other thing to or from such parcel of land or any structure thereon.
All spaces in which stopping and parking shall be prohibited as aforesaid shall be marked and indicated by suitable signs or markings.
This article shall take effect immediately, except that with respect to a structure or structures on any such parcel of land presently so constructed that such deliveries may not reasonably be made at a point other than the portion abutting the said street or highway without alteration thereof, this article shall take effect 90 days after its enactment.
Whenever the enforcement of this article would result in practical difficulties or unnecessary hardship, the Board of Trustees may, upon application by the owner or lessee of the property affected, in such form as the Board of Trustees may prescribe, and after public hearing held thereon, determine and vary the application of the regulations herein established in harmony with their general purpose and intent. Such application shall be accompanied by payment of a fee of $100 to the Village Clerk.

Any person who shall violate or refuse to comply with any of the provisions of this article shall be punished by a fine of not more than $300, and in addition thereto such violation shall constitute and is hereby declared to be disorderly conduct, and any person who shall violate or refuse to comply with any of the provisions of this article shall be and hereby is declared to be a disorderly person and may be punished as such.
