As used in this chapter, the following terms
shall have the meanings indicated:
The Town of Huntington Department of Transportation and Traffic
Safety which shall perform a major function of town government.
The Deputy Director of the Town of Huntington Department
of Transportation and Traffic Safety, who in the absence of the Director
shall act generally for and in place of the Director.
The Director of Transportation and Traffic Safety who shall
be the chief executive officer of the Department.
A.
There shall be in the Town of Huntington a Department
of Transportation and Traffic Safety. The principal executive officer
and administrative head of such Department shall be the Director,
who shall be appointed by and serve at the pleasure of the Town Board,
at a salary as may from time to time be fixed by the Board. The Director
shall be appointed on the basis of administrative experience and qualifications
for the duties of the office, and on such other basis as may be deemed
necessary by the Town Board.
B.
The Deputy Director shall generally act for and in
behalf of the Director and shall perform such duties as are vested
in and imposed upon that office by the provisions of this chapter,
by statute or by other lawful authority.
A.
The Director shall be the head of the Department,
with power and authority to appoint and remove officers and employees
under the Department's jurisdiction in accordance with the Civil Service
Law and other applicable laws, except the appointment and removal
of the Deputy Director, who shall be appointed and removed by the
Town Board.
B.
The Director shall have such powers as shall be necessary
for the proper administration of the Department consistent with applicable
provisions of law.
C.
The Director may establish, subject to Town Board
approval, a schedule of fees to be collected for services rendered
in connection with the work of the Department and for which the Director
deems it necessary to charge and collect.
D.
The Director shall investigate and make recommendations
to the Town Board on funding available through federal, state and
county agencies, and other sources as they become available, relating
to the maintenance, improvement or expansion of traffic safety and
transportation within the Town of Huntington.
E.
Provide consultation, administration, application
and inspection services, as required, with respect to laws of the
State of New York and the local laws, ordinances and codes of the
Town of Huntington.
F.
Such other authority and duties conferred by law,
rule or regulation, and as directed from time to time by the Town
Board.
B.
Each Division shall be under the administration, direction
and control of the Director. The Director may, with approval of the
Town Board establish, consolidate or abolish any division or subdivision
currently in existence or hereafter established within the Department.
C.
Division of Traffic Safety and Transportation Planning:
The Division of Traffic Safety and Transportation Planning shall be
authorized and empowered to perform the following functions:
(1)
Administer, supervise, manage, implement and direct
all matters pertaining to the fast, efficient, safe and convenient
movement of pedestrians and vehicles in the highway transportation
system established within the Town of Huntington.
(2)
Enforce and implement all rules and regulations governing
the flow of traffic, including the design and installation of curbs
and sidewalks pursuant to Town Law § 200 and § 200-a,
and oversee the nature and location of all roadway markings, traffic
signs, signals and devices.
(3)
Examine and analyze traffic patterns and conditions
on the streets and highways of the town, and submit recommendations
to the Town Board and other town departments regarding the modifications
and improvement of traffic plans and schemes, vehicular parking, and
movement along streets and highways under the jurisdiction of the
Town of Huntington.
(4)
Oversee the design, installation, location and maintenance
of all traffic signs, signals and devices under the jurisdiction of
the Town of Huntington.
(5)
Submit recommendations for the establishment of off-street
parking areas and facilities.
(6)
Develop and implement, when necessary, a master plan
for traffic safety, and administer the Town of Huntington Mass Transportation
Improvement Program.
D.
Division of the Huntington Area Rapid Transit System
(HART Bus). The Division of HART Bus shall be authorized and empowered
to perform the following functions:
(1)
Administer the Huntington Area Rapid Transit System,
including compliance with the requirements of all applicable federal,
state, county and local regulatory laws and rules.
(2)
Oversee the operation of mass transit, including the
establishment of bus routes and schedules, bus fares and other service
related functions, subject to the approval of the Town Board, where
applicable.
E.
Division of Streetlighting. The Division of Streetlighting
shall be authorized and empowered to perform the following functions:
(1)
Administer and operate the Townwide Streetlighting
District. Costs business shall be a charge against the district.
(2)
Provide technical services and oversee the maintenance,
repair, renovation and replacement of all lighting fixtures and appurtenances
along the streets and roadways under the jurisdiction of the Town
of Huntington.
Nothing contained in this Chapter shall be construed
to delegate or transfer any power of the Town Supervisor as provided
in § 29, § 52 and § 125 of the Town
Law of the State of New York, or any other power which may be lawfully
exercised by the Supervisor.
