It shall be unlawful to construct, maintain,
install or enlarge any outdoor water pool in any residential zone
in the Town of Huntington except in compliance with all of the provisions
of this Article.
As used in this Article, the following terms
shall have the meanings indicated:
A receptacle for water or an artificial pool of water having
a depth at any point of more than two (2) feet and a plane surface
area greater than one hundred (100) square feet, intended for the
purpose of immersion or partial immersion therein of human beings
and including all appurtenant equipment. The word "pool" shall be
construed to mean outdoor water pool.
Permits for the construction, installation,
enlargement or alteration of any pool shall be issued by the Director
and shall be subject to all applicable provisions of the Code of the
Town of Huntington.
Pool walls and floors shall be constructed of
any impervious material which shall provide a tight tank and shall
be of sufficient strength to contain the water therein.

All drawings and plans for the construction, installation,
enlargement or alteration of any pool shall be submitted to the Director
of Engineering Servicesfor examination and approval as to proper location
and construction.

(B)Â
Plans and drawings shall show lot lines and shall
include information pertinent to the pool, fence construction, water
supply system, drainage, water disposal system and all appurtenances
as well as detailed plans and vertical elevations.
(C)Â
Pools, appurtenances, water supply and drainage systems
and fences shall be constructed in conformity with the approved plans.
All water either overflowing or emptying from
the pool shall be disposed of on the owner's land, and plans submitted
shall show provisions made for preventing such water from flowing
onto the land of any adjoining property owner or into any abutting
street.

(A)Â
All pools shall be completely enclosed by a permanent fence, wall,
or barrier and all openings or points of entry into the pool area
enclosure shall be equipped with gates. The barrier and gates shall
be not less than four (4) feet in height above the grade level and
shall be constructed in accordance with the Uniform Fire Prevention
and Building Code of the State of New York. As provided therein, all
gates shall be equipped with self-closing and self-latching devices
as well as child-proof locks which shall be locked whenever the pool
is unattended.

Upon approval by the Director, an adjoining property owner's fence
may be utilized to satisfy the applicable requirements if consented
to by the adjoining property owner in writing and sworn to before
a notary public, and the consent is submitted to the department. If
the adjoining property owner's fence is ever removed, in disrepair,
or in any way fails to prevent entry, then the pool owner shall immediately
close and make safe the pool from entry until such adjoining fence
is repaired, or a conforming fence or barrier fully enclosing the
pool is erected by the pool owner.

If an applicant must erect a fence that runs flush with an adjoining
property owner's fence, then it must be equal in height to the adjoining
fence, and subject to all applicable codes, laws, and regulations.
All pools shall comply with the requirements of this Chapter 87 relating to accessory buildings, except that the lot area occupied by such pools shall not be included in computing the percentage of lot area which may be built upon.
All lights used to illuminate the pool or pool
area shall be shielded so as to prevent their shining upon the property
of any adjacent property owner.
