A. 
Since there is danger to life and property inherent in the use of electrical energy, this chapter is enacted to regulate the installation and alteration of electrical work and wiring for electric lighting, heat or power and signal systems operating on 50 volts or more in or on all real property within the unincorporated area of the Town of Huntington.
B. 
The provisions of this chapter shall constitute the rules regulating the installation of electrical wiring and equipment in the Town of Huntington, New York.
A. 
Word usage. The terms "person" and "applicant" as used herein shall not be construed to include a copartnership, association or corporation.

B. 
Definitions. As used in this chapter, the following words shall have the meanings indicated:
ELECTRICAL WIRING AND EQUIPMENT
Includes all wiring, raceway and associated control and distribution equipment and all utilization equipment operating on electrical energy which is connected to the supply by means other than portable cord and plug in or on buildings, including signal and control systems operating at 50 volts or more, but not including installations on ships railway cars, automotive equipment or in railway, electrical or communication utility plants in the exercise of their functions as utilities.
TOWN
Refers to the Town of Huntington, excluding incorporated villages.
TOWN BOARD and CHIEF BUILDING INSPECTOR
Such body or officer of the Town of Huntington, or any agency or individual of the town designated by the town to assume the duties delineated herein.
All electrical installations heretofore mentioned shall be made in conformity with the requirements of the National Electrical Code except where the provisions of this chapter or any other local law, chapter or state code of the Town of Huntington shall differently prescribe, in which event compliance with the provisions of such local law, chapter or code shall be recognized as proper compliance with this chapter. The requirements of the National Electrical Code shall be those known as National Fire Protection Association Pamphlet NFPA No. 70, as approved and adopted by the American Standards Association.
A. 
The Chief Inspector and each of the duly appointed Inspectors of the New York Board of Fire Underwriters and such other approved electrical inspection agencies as found qualified by the Director of Engineering Services are hereby authorized to make inspections and reinspections of all electrical installations heretofore and hereafter described and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections and reinspections be a charge against the Town of Huntington.

B. 
Duties.

(1) 
It shall be the duty of the Electrical Inspector to report in writing to the Director of the Department of Engineering Services, whose duty it shall be to enforce all the provisions of this chapter, all violations of or deviations from or omissions of the electrical provisions of the National Electrical Code, and of all local laws, ordinances and the Building Code,[1] as referred to in this chapter, insofar as any of the same apply to electrical wiring.

(2) 
The Electrical Inspector shall make inspections and reinspections of electrical installations in and on properties in the Town of Huntington upon the request of an authorized official of the Town of Huntington or as herein provided. The Electrical Inspector is authorized to make inspections or reinspections of electrical wiring, installations, devices, appliances and equipment in and on properties within the Town of Huntington where he deems it necessary for the protection of life and property.
(3) 
It shall be the duty of the Inspector to furnish written reports to the proper officials of the Town of Huntington and to the owners and/or lessees of property where defective electrical installations and equipment are found upon inspection. He shall authorize the issuing of a certificate of compliance when electrical installations and equipment are in conformity with this chapter. He shall direct that a copy of the certificate of compliance be sent to the Director of the Department of Engineering Services of the Town of Huntington.

The provisions of this chapter shall not apply to the electrical installations in ships, railway cars or automotive equipment, nor the installations or equipment employed by a railway, electrical or communication utility in the exercise of its function as a utility and located outdoors or in buildings used exclusively for that purpose. This chapter shall not apply to any work involved in the manufacture, assembly, test or repair of electrical machinery, apparatus, materials and equipment by a person, firm or corporation engaged in electrical manufacturing as its principal business. It shall not apply to any building which is owned or leased in its entirety by the government of the United States or the State of New York.

This chapter shall not be construed to relieve from or lessen the responsibility of any person owning, operating, controlling or installing any electrical wiring, devices, appliances or equipment for loss of life or damage to person or property caused by any defect therein, nor shall the Town of Huntington be deemed to have assumed any such liability by reason of any inspection made pursuant to this chapter.

No person shall, for compensation, install, repair, alter or modify any electrical work in the Town of Huntington unless he meets the requirements of the Suffolk County Plumbing and Electrician Licensing Board.

Editor's Note: This ordinance also provided for the repeal of three original sections of this chapter having to do with licensing of electricians. In addition, this ordinance provided that this enactment and the publication of same would take effect simultaneously with the passage by the Suffolk County Legislature of the proposed Suffolk County Occupational Licensing Law, said law to contain, among other provisions, a Section 1.6, Exemption from examination, and Section 1.17, Reciprocity with other political subdivisions.

A. 
On installations, modifications, repairs and/or additions to electrical installations covered under Section 90-2(a) of the current edition of the National Electric Code using wire size AWG No. 4 and smaller, only copper material shall be used, and that shall comply with all applicable current sections of the National Electric Code.
B. 
On installations using wire size AWG No. 2 and larger aluminum wire or wire utilizing aluminum in combination with other materials where the principal metallic component is aluminum, e.g., nickel-clad aluminum, cooperclad aluminum, etc., each termination or splice on such wire shall be made only by compression connectors approved for the purpose and applied in full conformance with approved procedures.
C. 
Any person, firm or corporation making any repair or modification to an existing installation on which the existing conductors are found to be aluminum wire or wire which is primarily aluminum, in sizes AWG No. 4 and smaller, shall make all connections, splices and terminations only in full conformance with procedures recognized by the National Electrical Code, utilizing only such materials, devices and equipment as have been listed for such use.
D. 
In making repairs or modifications to existing installations, direct connection to switches and receptacles shall be made only with copper wire pigtail splices to the aluminum wire, using only insulated connectors listed for joining aluminum and copper listed for such use by a recognized testing laboratory.

A. 
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter electrical wiring for light, heat or power in or on properties in the Town of Huntington until an application for inspection has been filed with the New York Board of Fire Underwriters or such other approved electrical inspection agency as set forth in § 104-4A above.
B. 
It shall be a violation of this chapter for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power to any source of electrical energy supply prior to the issuance of a temporary certificate or a certificate of compliance by the New York Board of Fire Underwriters or such other approved electrical inspection agency as set forth in § 104-4A, above.

Any person, firm or corporation who shall violate any of the provisions of this chapter or any rule or regulation made pursuant thereto shall be guilty of an offense against this chapter and, upon conviction thereof, may be punished by a fine of not less than five hundred ($500) dollars and not more than two thousand five hundred ($2,500) dollars, and each day on which such violation continues shall constitute a separate offense. Any person found by the Bureau of Administrative Adjudication to have violated this chapter shall likewise be subject to a monetary penalty within the range of fines authorized herein for offenses or continuing offenses.
