There is hereby adopted this Local Law No. 39-1979, establishing and adopting a body of legislation for the governance of said Village, officially designated the "Code of the Incorporated Village of Sea Cliff," hereinafter referred to as the "Code," consisting of Chapters 2 through 138, heretofore adopted on September 17, 1979, by Local Law No. 1-1979 through No. 38-1979, together with such Appendix chapters as shall be deemed advisable by the Board of Trustees. This local law shall be included in said Code as Chapter 1, Adoption and Administration of Code.
This Code shall be a new and original body of legislation which shall supersede and repeal all other local laws, ordinances, orders, schedules, resolutions and rules and regulations hereinbefore passed or adopted by the Board of Trustees, with the exception of Local Law No. 1-1979 through No. 38-1979 together with the Appendix chapters adopted therewith.
A. 
Any and all local laws or other legislation adopted in such form as to indicate the intention of the Board of Trustees to be a part of this Code, whether as amendments, deletions or supplements to chapters (or articles) then appearing in the Code or as new chapters (or articles) to be added to said Code, shall be deemed to be incorporated into such Code so that reference to the "Code of the Incorporated Village of Sea Cliff" shall be understood and intended to include such additions, deletions, amendments or supplements. Whenever such additions, deletions, amendments or supplements to the Code shall be enacted or adopted, they shall thereafter be inserted in the official copy of the Code maintained by the Village Clerk.
B. 
Amendments to the body of the Code shall be by local law,[1] and amendments to the Appendix shall be by resolution of the appropriate Village board, department or agency, subject to the approval by resolution of the Village Board of Trustees. Nonsubstantive material, including but not limited to a Serial Page, Preface, Table of Contents and Index may be prepared and inserted as required in this Code, and changed as necessary, without further authorization from the Board of Trustees.

A copy of this Code shall be kept on file in the office of the Village Clerk of the Incorporated Village of Sea Cliff, preserved in loose-leaf form or in such other form as the Village Clerk may consider most expedient. It shall be the express duty of the Village Clerk or someone authorized by said Clerk, in writing, to insert in their designated places all additions or amendments to this Code which indicate the intention of the Board of Trustees to make same a part hereof, when same have been printed or reprinted in page form, and to extract from this Code all provisions which may, from time to time, be repealed by said Board of Trustees. Said copy of this Code shall be certified by the Village Clerk by impressing thereon the Seal of the Incorporated Village of Sea Cliff, shall be considered the official Code of the Incorporated Village of Sea Cliff and shall be available for examination during normal business hours by any person desiring to examine same.
Any person who, without authorization from the Village Clerk, changes or amends, by additions or deletions, any part or portion of this Code or who alters or tampers with such Code in any manner whatsoever which will cause the legislation of the Village of Sea Cliff to be misrepresented thereby or who violates any other provision of this Code shall, upon conviction thereof, be subject to the penalty provisions set forth in Article II of Chapter 2.
Copies of this Code, or portions thereof, shall be prepared and distributed in such form, quantity and manner as the Board of Trustees shall from time to time determine by resolution. The sale of such copies, at a price to be fixed by resolution of the Board of Trustees, is also specifically authorized. The Clerk shall keep a record of the names and addresses of holders of such copies and shall notify them by mail whenever additions, deletions, amendments or supplements to the Code are adopted and the cost of purchasing copies of same.
In accordance with the powers vested in the Board of Trustees to adopt local laws,[1] this Code and each of its chapters, articles, sections, paragraphs, sentences, parts, clauses and other provisions hereof shall be deemed to amend and supersede the Village Law of the State of New York in the latter's application to the Incorporated Village of Sea Cliff to the extent that this Code and each of its chapters, articles, sections, paragraphs, sentences, parts, clauses and other provisions shall conflict with said provisions of the Village Law of the State of New York.
