There is hereby created an Examining Board of
Plumbers (hereinafter referred to as the "Examining Board" or the
"Board") consisting of two master plumbers and one journeyman plumber.
If possible, all shall be residents of the Village. The members of
the Examining Board shall be appointed and the Chairman thereof shall
be designated by the Mayor with the approval of the Board of Trustees.
Initial terms shall be for one, two and three years, respectively,
and thereafter, one member of such Board shall be appointed annually
for the full term of three years. The purpose of the Examining Board
shall be to determine the competency of plumbers applying for licenses
hereunder.
A.
No person shall install, alter or replace or add to
any water, gas, soil, waste, drainage or vent pipe, fitting or apparatus
nor engage in or conduct the business of plumbing in the Village unless
he shall be licensed by the Village Clerk to engage in the business
of plumbing as provided for in this article. The foregoing provisions
of this section notwithstanding, minor repairs not involving the installation
of new gas, soil, waste, drainage or vent pipes or the connection
of additional fixtures to existing gas, soil, waste, drainage or vent
pipes may be made by a person not licensed under this article.
B.
The fee for and duration of such license, including any renewal thereof, shall be as set forth in Chapter A142, Schedule of Fees. Such fee shall accompany each application, which shall be in writing and shall be filed with the Building Inspector. The form for such application shall be as prescribed by the Building Inspector.
C.
A license hereunder shall be issued by the Village
Clerk upon approval of the application by the Building Inspector.
Except as otherwise provided herein, no person
shall make application for a plumbing license to engage in or conduct
the business of plumbing within the Village until he shall first have
obtained a certificate of competency from the Examining Board.
A.
Persons applying for examination for a certificate of competency shall, before being examined, file with the Examining Board an application on such forms as may be prescribed by the Board and shall furnish to the Board such information as it may require concerning the applicant's fitness and qualifications to receive such certificate. The fee for such examination or any reexamination shall be as set forth in Chapter A142, Schedule of Fees, and shall accompany each application. Such fee shall not be refundable. All applications must be made under oath.
B.
Each applicant shall be required to furnish sworn
references from two licensed plumbers, on forms prescribed by the
Examining Board, certifying as to the applicant's ability and fitness
to take the examination.
C.
The Examining Board may refuse to receive an application
from a person who at the time of making application may be unlawfully
engaged in business as a master or employing plumber.
No person shall be examined unless he shall
have had three years' experience as a journeyman plumber and is able
to furnish satisfactory evidence of such fact.
A.
The Examining Board shall arrange and conduct an examination
as to the competency and qualifications of such applicant. The content
of such examination shall be determined by the Board and approved
by the Board of Trustees.
B.
The specific time and place of holding examinations
shall be at the discretion of the Examining Board. However, such examinations
shall be held within the Village and within six months of the filing
date of the application.
C.
Persons who pass the examination as prescribed by
the Examining Board shall be eligible to receive a certificate of
competency as a master or employing plumber and to apply for a license
to engage in or conduct the business of plumbing within the Village.
Each applicant must pass with an average of 70% in order to receive
such certificate.
D.
An applicant who fails the examination shall not be
eligible for reexamination until the expiration of three months thereafter.
Such reexamination shall be given upon payment of the required fee
and upon filing a written request therefor, upon such form as may
be prescribed by the Examining Board. Should the applicant fail to
request a reexamination within a period of one year from the date
of such applicant's most recent examination, a complete new application
shall be required, including new sworn references.
A.
Where an applicant for a plumbing license who, at
the time of making such application, maintains a principal place of
business within the County of Nassau, has been duly licensed as a
master plumber by a municipality within the County of Nassau with
whom the Village has entered into a reciprocity agreement, the examination
for a certificate of competency will be waived, provided that the
applicant shall file with the application a certificate of competency
and a certified copy of a currently valid master plumber's license
from such other municipality. In such case, the license application
shall be reviewed by the Examining Board as well as the Building Inspector,
and, upon approval, such applicant shall be considered a duly licensed
master plumber within the Village.
B.
Where an applicant for a plumbing license who, at
the time of making such application, is a duly licensed master or
employing plumber in any other municipality in the State of New York,
submits a certified copy of a certificate of competency issued by
the Examining Board of Plumbers in such municipality and a certified
copy of a currently valid master plumber's license from such other
municipality, and if he maintains his principal place of business
in such municipality, the examination for a certificate of competency
will be waived, provided that such municipality has signified, in
writing, its willingness to reciprocate in like manner with the Village.
In such case the license application shall be reviewed by the Examining
Board as well as by the Building Inspector, and, upon approval, such
applicant shall be considered a duly licensed master plumber within
the Village.
C.
No applicant licensed under this section shall be
issued a certificate of competency unless and until he has been examined
by the Examining Board.
A license granted under the provisions of this
section may be revoked by the Examining Board for cause. In such case,
notice shall be given to the licensee of the proposed revocation,
and a hearing shall be held before the Examining Board on the matter,
at which hearing the licensee shall have an opportunity to appear
and be heard in relation to such proposed revocation.
No licensee shall directly or indirectly allow
his license to be used in connection with work wherein he is not the
contractor or subcontractor and personally responsible for the work
done.
