Any person found to be violating any provision of this chapter except Article VI shall be served by the town and/or village with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violation.

Any person who shall continue any violation beyond the time limit provided for in § 122-41 shall be punishable by a fine of not more than $250 or imprisonment for a period not exceeding 15 days, or both.

Editor’s Note: L.L. No. 8-2008, adopted 12-8-2008, created a uniform section for the application of penalties occurring when any ordinance, resolution or act of the Village is violated. See Ch. 1, General Provisions, Art. II, General Penalty.
Any person violating any of the provisions of this chapter shall become liable to the town and/or village for any expense, loss or damage occasioned the town and/or village by reason of such violation.
Notwithstanding the other sanctions in this Article VIII, the town or village may bring proceedings in Supreme Court of the State of New York to enjoin the continued violation of this chapter.
