GENERAL REFERENCES
Streets and sidewalks — See Ch. 132.
Any person who shall climb, cut, bruise, break or in any manner injure any shade or ornamental tree within the Village of Wappingers Falls shall for each offense be subject to a penalty as set forth in § 139-4.
It shall be the duty of the owners or occupants of any house or premises in said Village, in front of whose premises or lot any shade trees have been planted, to keep the same trimmed to a sufficient height that they will not obstruct the light of any street lamp where any lights are or hereafter may be located, under a penalty as set in § 139-4 for each such neglect or refusal; and in case of a failure to comply with this section, the Trustees may direct the same to be done and collect the expense thereof from the owner or occupant of such lot, in the same manner that other taxes and assessments are now by law authorized to be collected.
Residents are not allowed to plant fruit, berry or pine trees with cones that would fall onto sidewalks and streets in the areas between the roadway curbing and the sidewalk. If residents desire to do so, they must come before the Village Board to request permission to do so and will be subject to the penalty provisions of § 139-4 and be required to pay for the removal of said tree(s) if permission is denied.
Any person violating any provision of this chapter may be punishable by a fine of not more than $250 or imprisonment for a period not exceeding 15 days, or both.
