No commercial establishment required to be licensed by the city shall provide entertainment between the hours of 2:00 a.m. to the following 8:00 a.m. each day. Entertainment includes live entertainment and/or recorded music but does not include recorded music which is intended solely to provide background music at restaurants. This section shall in no manner modify other provisions of Chapter 120 which impose stricter entertainment hours for certain types of commercial establishments.
A.
Whenever in this chapter any act or failure to do a required
act is prohibited or is made or declared to be unlawful or an offense or a
misdemeanor, where no specific penalty is provided therefor, the violation
of any such provision of this chapter shall be punished by a fine of not less
than $50 nor more than $150, such fine to be in the discretion of the court,
and such violator shall pay the costs of prosecution.
B.
Whenever in this chapter there is no provision for a
greater penalty for a second or subsequent conviction for a violation of this
chapter, any person who has previously been convicted of the same violation
shall be subject to a fine of not less than $75 nor more than $200 for each
succeeding offense and shall pay the costs of prosecution.
