All officers of the Police Department of the Borough of Eatontown shall be dedicated to assist in the prevention and detection of crime and apprehension of offenders and the protection of persona and property under the laws of the State of New Jersey, protection of the innocent and enforcement of the laws of the State of New Jersey and ordinances of the Borough of Eatontown.
Said officers shall maintain discipline and efficiency in the Department and in the discharge of their duties as such officers, and each and every member of the Police Department is personally charged with the duty to maintain such discipline and efficiency.
It is hereby ordained that the rules and regulations to promote efficiency and discipline in the Police Department as set forth in a resolution passed by the Mayor and Council of the Borough of Eatontown entitled, "Resolution fixing and determining the rules and regulations for the Police Department of the Borough of Eatontown in the County of Monmouth," at a meeting held on February 9, 1955, be and the same is hereby adopted as the standard of such discipline and efficiency as required in order to carry out the policy and purposes of the Police Department as herein set forth.

This ordinance shall take effect immediately upon its passage and approval, as provided by law.

There shall be a branch of the Department known as the Detective Bureau which shall be under the supervision, control and direction of the Chief of Police, but in the immediate charge of the Captain or such other Superior Officer as may be assigned by the Chief of Police. The Detective Bureau shall be located at Police Headquarters and shall include detective services at all times of the day and night, the Bureau of Criminal Identification and Records and such other bureau, squads or units as may be created. The Bureau shall consist of a Commanding Officer, who shall be a captain, sergeants and other officers and employees as may be assigned to the Bureau from time to time by the order of the Chief of Police.
The Commanding Officer shall have general supervision and personal direction of the management of the Detective Bureau, subject at all times to the orders of the Chairman of the Police Committee and the Chief of Police. He shall devote his best efforts to the investigation and solution of criminal cases occurring in any part of the Borough. He shall devote his entire time and energy to the duties of his office and give his best efforts to the prevention of crime, investigation and solution of all offenders, locating of missing persons, suppression of gambling and vice in all parts of the Borough, criminal investigations for other cities, and fugitive requisition proceedings. He shall see that all members of the Detective Bureau are assiduous and energetic and perform their respective duties in an intelligent, faithful and capable manner. He shall be generally responsible for the efficiency and discipline of the Detective Bureau and the enforcement of the rules and regulations applicable thereto. He shall always remember to promote and maintain between the said Bureau and the other branches of the services a spirit of cooperation and mutual help, to the end that the purposes for which a permanent police force is established are attained.
The operation of the Detective Bureau will particularly embrace all investigations of robbery, burglary, arson, rape, murder, manslaughter (excepting cases involving death by automobile) and all important and serious criminal cases in any part of the Borough.
Whenever a crime of great magnitude or importance or a matter of serious Department concern is reported to the Commanding Officer of the Detective Bureau, he shall immediately advise the Chief of Police of the facts pertaining thereto.
The Commanding Officer of the Detective Bureau shall, when a crime has been reported to his Bureau, assign the case to one or more of his men, who shall make detailed reports to him as frequently as may be required by the facts developed, withholding neither names nor details which may be essential to the case.
The Chief of Police shall, whenever practicable, personally visit the scenes of unusual and important crimes and acquaint himself with the locations and conditions, so he may better direct investigation in such cases. When advisable, he shall cause photographs to be taken and charts to be made of the scene of any crime for possible use in court, and cause fingerprints to be photographed as evidence in criminal cases whenever obtainable. He shall cause verbatim statements to be taken of all persons involved or suspected of being involved (including witnesses) in all major and important crimes. He shall obtain descriptions, photographs and fingerprints of unknown dead for the purpose of identification. He shall cause antemortem statements to be taken promptly, properly and carefully.
The Commanding Officer of the Detective Bureau shall, whenever it becomes necessary to be absent from his office during his hours of duty, place in charge a Superior Officer who shall assume control and command of the Bureau.
The Detective Bureau shall function 24 hours daily and the members thereof shall report at such times as may be ordered by the Chief of Police.
The Commanding Officer of the Detective Bureau shall report to the Chief of Police, in writing, all complaints against members of the Detective Bureau made by citizens or members of the Department, and shall take verbatim statements in all investigations he may make pertaining thereto.
The Commanding Officer of the Detective Bureau shall see that every case coming within the scope of the duties of the Detective Bureau is promptly and efficiently handled, and keep or cause to be kept an accurate and complete record in each case.
The Commanding Officer of the Detective Bureau shall detail such number of men in his command as he may deem necessary to strictly enforce the laws and ordinances relating to pawnshops, pawnbrokers, sales stores and secondhand stores, and to examine pawnbrokers' books with a view to the identification and recovery of stolen property.
The Commanding Officer of the Detective Bureau shall make annual and monthly reports to the Chief of Police of the services performed by the Detective Bureau.
Members of the Detective Bureau having or receiving information that may assist in bringing persons charged with violation of the law to justice, or the recovery of stolen property, will report the same to the Commanding Officer of the Bureau.
Members of the Detective Bureau shall be particularly charged with the prevention of crime and the investigation of criminal cases in the Borough, the detention and arrest of criminal offenders, the recovery of lost and stolen property, the cooperation with other authorities and the responsibility of giving vigilant scrutiny to, and taking proper cognizance of, all conditions relating to, or tending towards, time fostering of crime.
Members of the Detective Bureau shall cooperate with one another and with all other members of the Police Department in the prevention and detection of crime, the arrest of criminals and the enforcement of all the laws of the state and ordinances of the Borough of which the Department takes cognizance, bearing in mind that they are policemen responsible for the performance of all police duty and required to observe all the rules and regulations applicable to them as members of the Department.
Members of the Detective Bureau, in the interest thereof, shall have free access to interview any prisoner or person in the station house, or confined therein, and shall have access to all criminal records connected with the Police Department.
Members of the Detective Bureau, through their Commanding Officer, in the interest of the Bureau, shall make charges against any officer or member of the Department to the Chief of Police, who causes obstacles to be put in the way of members of the Detective Bureau or giving information damaging to the success of the Bureau. Such charges, if sustained, shall be followed by dismissal.
Members of the Detective Bureau shall at all times cooperate in their work with the uniform branch of the Department, and endeavor at all times to see that the utmost harmony prevails between the branch of the service and the uniform of the Department.
The fact that a member of the Department is assigned for duty to the Detective Bureau shall not be construed as relieving him of the responsibility of taking prompt and proper action in the matter of any violation of the laws, ordinances and regulations coming to his attention.
A record of all complaints calling for the attention of the Detective Bureau shall be kept in the Detective Office under the supervision of the Commanding Officer, or, in his absence, the officer designated to perform his duties; said record to contain the date and nature of complaint, name of complaint, description and value of property lost or stolen, date of offense, name of detective to whom case is assigned and name of person charged, if known. There shall also be kept a record of all arrests, description of property recovered and final disposition of all cases, sentence, etc.
All reports of detectives of their action in relation to the case assigned to them shall be filed in connection with the entries of the case in the Detective Record.
The Superior Officer and members of the Detective Bureau shall be subject to all the rules and regulations laid down for guidance and government of other members of the Police Department insofar as they are applicable and do not conflict with the specific rules prescribing the duties of the Detective Bureau.
