A single platform which is mounted on wheels,
designed or used in fact for riding underfoot, having no mechanism
or other device with which to steer or control the direction of movement
thereof while being used.

No person shall use or ride a skateboard in,
on, or upon any publicly owned monument, sculpture, or other statuary.

A.
Any police officer who shall observe any person using
or riding upon a skateboard in violation of this article shall take
possession of the skateboard and issue a dated, written notice of
such violation to such person or, if such person is under the age
of 18 years, to the person and his or her parent or guardian, together
with a copy of this article, and shall file a copy of such written
notice with the Clerk of Albany City Court civil team.
B.
For a first offense, the skateboard shall be returned
to the rider upon his or her appearance, if 18 or older, in said City
Court. If the rider is under 18, it shall be returned upon the appearance
of the rider and his or her parent or guardian in City Court.
C.
In the case of a second or third violation, the skateboard
shall not be returned to the rider for 30 days from the date of the
violation, and shall be returned at that time upon appearance of the
rider in City Court or, if the rider is under 18 years of age, upon
the appearance of the rider and his or her parent or guardian in City
Court.
D.
Upon a fourth or subsequent violation, the skateboard
shall not be returned to the rider and shall be forfeited to the City
of Albany.
