The Common Council hereby finds and declares
that the burning and incineration of trash, garbage and/or other types
of household waste without pollution control equipment poses an unacceptable
environmental and health risk to the citizenry requiring the imposition
of legislative safeguards.
As used in this article, the following terms
shall have the meanings indicated:
Equipment or facilities used to burn mixed garbage or other
household-type waste generated and/or collected from the building
or area containing such equipment.
On and after January 1, 1992, the burning of
mixed garbage and household waste in on-site incinerators shall be
and is hereby prohibited.
Violations of the provisions of this article shall be subject to the penalty and prosecution provisions set forth in Chapter 258 of the Code of the City of Albany.
