The Board of Trustees of the Village of Briarcliff Manor determined it appropriate to establish a local law to grant authority to the Village Manager, or his designee, to declare a storm emergency. Article 2-B of the Executive Law provides that in the event of a disaster, the Village Manager, or his designee, is authorized to declare a local state of emergency within the Village and to issue local emergency orders to protect life and property or to bring the emergency under control.
It shall be the duty of the Village Manager, or his designee, to declare a storm emergency. Such condition will exist whenever he/she finds that falling snow, sleet or freezing rain or inclement weather will create a condition which makes it necessary that the standing or parking of motor vehicles on Village streets be prohibited to allow for the uninterrupted removal of snow or debris. Upon such declaration, a time and date for the storm emergency declaration shall be established directing that all vehicles must be removed from Village streets not more than one hour after such declaration and remain off the streets until such time the declaration expires.
After a reasonable effort to contact the owner of a vehicle, the Briarcliff Manor Police Department is authorized to remove, or have removed, any vehicle impeding passage of emergency vehicles during the storm emergency. The Police Department will maintain a record of the location to which the vehicle has been towed. The owner shall have the responsibility of retrieving the vehicle and paying all towing charges incurred. Any person violating provisions of this chapter by failure to follow the direction of the Police Department to remove a vehicle from a public street shall upon conviction be punished by a fine of not more than $250.
