Village of Ocean Beach, NY Chapter 33 Special Service Attendants

§ 33-1 General purpose.

The general purpose of this chapter is to allow the Village Board to create the position or positions of Special Service Attendant(s), who will be given the authority to issue summonses and/or appearance tickets for violation of village ordinances upon property owned and/or controlled by the village and the enforcement of other village ordinances.

§ 33-2 Designation of attendants.

Officers, peace officers, building inspectors and other employees of the Incorporated Village of Ocean Beach may, as designated by the Village Board as Special Service Attendants authorized, be directed and permitted to issue appearance tickets pursuant to the Criminal Procedure Law in the course of any prosecution against violations of the Code of the Incorporated Village of Ocean Beach. This section shall in no way confer to them the power to issue summonses and/or appearance tickets conferred upon persons elsewhere than in this chapter.

§ 33-3 Provision for verification on appearance tickets.

The form of appearance tickets shall provide for verification pursuant to § 100.30, Subdivision 1(d), of the Criminal Procedure Law.

§ 33-4 Provision for pleading on appearance tickets.

Alternate modes of pleading by the defendant shall be provided on the reverse side of the appearance ticket as follows:

A. Entry of a plea of guilty before the Clerk of the Court.

B. Entry of a plea of guilty by mail.

C. Power of attorney authorizing the Clerk of the Court to plead guilty on the defendant's behalf.

§ 33-5 When effective.

This chapter shall be effective immediately.
