This chapter shall be known and may be cited as the "Traffic Ordinance of the Town of Shelter Island."

All vehicles proceeding east on Manwaring Road, when passing around the traffic circle at the easterly terminus of Manwaring Road, shall be driven only to the right of said traffic circle, and the Superintendent of Highways of the Town of Shelter Island is hereby directed to install and maintain a keep-to-right sign on Manwaring Road at said traffic circle.
Stearns Point Road, from its intersection with Shore Road to a point 500 feet east of Prospect Avenue, is hereby designated as a no-passing zone.
A. 
No person shall park a vehicle, nor shall the registered owner of a vehicle cause, suffer, allow or permit said vehicle to be parked within the area designated as a FIRE ZONE - NO PARKING BETWEEN SIGNS, and the extension southerly by white painted lines from the Town bulkhead at the Shelter Island Town Dock to the northerly boundary line of State Highway Route 114. The Superintendent of Highways of the Town of Shelter Island is hereby directed to install and maintain no-parking signs in said restricted area.

No person shall park a vehicle, nor shall the registered owner of a vehicle cause, suffer, allow or permit said vehicle to park within the designated parking area established on the westerly side of the Town right-of-way at the Town dock at Dering Harbor bordering the westerly side of the designated fire zone for a period in excess of two hours between the hours of 8:00 a.m. and 6:00 p.m., at any time that parking permits are in effect.

A. 
There shall be a pedestrian crosswalk adjacent to the Shelter Island School on School Street.
B. 
There shall be a pedestrian crosswalk on Grand Avenue near the intersection of Grand Avenue and Chase Avenue; said crosswalk shall be an extension of the sidewalk which runs on the north side and parallel to Chase Avenue.

C. 
There shall be a pedestrian crosswalk on Grand Avenue near the intersection of Grand Avenue and Sylvan Place; said crosswalk shall be an extension of the sidewalk which connects to the stairway in front of the United States Post Office on Grand Avenue.

D. 
There shall be a pedestrian crosswalk on Grand Avenue near the intersection of Bay Avenue (on the Prospect Park, north side).

A. 
No person shall park a vehicle, nor shall the registered owner of a vehicle cause, suffer, allow or permit said vehicle to park on the easterly side of Duval Road for a distance of 100 feet southerly from the intersection of Route 114 and Duval Road.

B. 
Parking is prohibited at an angle greater or lesser than 30° on the north side of Shore Road, a county road, between Stearns Point Road and the Town landing, a distance of 0.6 mile.

C. 
Wades (Tuthill's) Beach.

(1) 
No person shall park a motor vehicle or motorcycle at any location within the parking lot area at Wade's (Tuthill's) Beach unless that vehicle shall display a valid and current Shelter Island Town parking permit.
(2) 
There shall be no parking on either side of Midway Road from a point 300 feet north from the entrance to Wade's (Tuthill's) Beach to a point 600 feet east from the entrance to Wade's (Tuthill's) Beach at any time when parking permits are in force.
D. 
No person shall park a vehicle, nor shall the registered owner of a vehicle cause, suffer, allow or permit said vehicle to park on either side of Shore Road northerly to the Town landing at the foot of the hill, a distance of approximately 0.3 mile.

E. 
No person shall park a vehicle, nor shall the registered owner of a vehicle cause, suffer, allow or permit said vehicle to park on the northwesterly side of Stearns Point Road a distance of 800 feet from the intersection of Stearns Point Road and Shore Road.

F. 
Menhaden Lane.

(1) 
No person shall park a motor vehicle or motorcycle on any portion of Menhaden Lane where parking is permitted unless that vehicle shall display a valid and current Shelter Island Town parking permit.
(2) 
There shall be no parking on the north side of Menhaden Lane at any time when parking permits are in effect.
(3) 
There shall be no parking on the south side of Menhaden Lane from a point 138 feet east of Gardiner's Bay Drive and running in an easterly direction for a distance of 75 feet at any time when parking permits are in effect.
(4) 
There shall be no parking on either side of Gardiner's Bay Drive from a point 600 feet north from Menhaden Lane to a point 600 feet south from Menhaden Lane at any time when parking permits are in force.

No person shall park a vehicle for more than one hour between the hours of 9:00 a.m. and 5:00 p.m. on the east side of Grand Avenue from a point 25 feet north of Chase Avenue to a point 15 feet south of pole No. 12 at any time that parking permits are in effect.

Q. 
No person shall park a vehicle for more than one hour between the hours of 9:00 a.m. and 5:00 p.m. on the west side of Grand Avenue from a point 50 feet north of the intersection of Grand Avenue and Chase Avenue to the alley between the Shelter Island Heights Pharmacy and the Chequit Inn at any time that parking permits are in effect.

R. 
No person shall park a vehicle for more than two hours between the hours of 9:00 a.m. and 5:00 p.m. on the east side of Grand Avenue between the intersection of Grand Avenue and Meadow Place and the intersection of Grand Avenue and Chase Avenue at any time that parking permits are in effect.

S. 
No person shall park a vehicle for more than two hours between the hours of 9:00 a.m. and 5:00 p.m. on the west side of Grand Avenue between pole No. 19 and pole No. 15 at any time that parking permits are in effect.

T. 
There shall be no parking on the west side of Sunnyside Avenue between pole No. 15 and a point 20 feet northeast of pole No. 18.

There shall be no parking on the east side of Prospect Avenue between pole No. 19 and a point which is opposite a point 30 feet north of Gurney's driveway on the west side of Prospect Avenue.

There shall be no parking on the west side of Washington Street from the corner of Waverly Place to the corner of Prospect Avenue.

Editor's Note: This local law also provided that it shall not apply to residents of Washington Street or their guests who are permitted to park directly in front of their property, provided that such parking does not occur on any paved portion of the street.

No person shall park a motor vehicle or motorcycle along the waterfront on Bootlegger's Alley and on the southeastern side of Bootlegger's Alley from the beachfront running east (landward) for 160 feet unless that vehicle shall display a valid and current Shelter Island Town parking permit.
(2) 
No person shall park a motor vehicle or motorcycle on the northwest side of Bootlegger's Alley commencing 100 feet from the beachfront running east (landward) for 335 feet unless that vehicle shall display a valid and current Shelter Island Town parking permit.
(3) 
No person shall park a motor vehicle or motorcycle on the northwest side of Bootlegger's Alley commencing 30 feet from the intersection with Nostrand Parkway running west (seaward) for 290 feet unless that vehicle shall display a valid and current Shelter Island Town parking permit.
(4) 
There shall be no parking at any other location on Bootlegger's Alley at any time that parking permits are in effect.
(5) 
There shall be no parking on Brander Parkway or West Neck Road within 50 feet of the intersection with Bootlegger's Alley.
(6) 
There shall be no parking within six feet of any driveway or intersection on Bootlegger's Alley at any time.
(7)

KK. 
Congdon Road.

No person shall park a motor vehicle or motorcycle on the southeast side of Hiberry Lane commencing from the shoreline running southwest (landward) for 85 feet unless that vehicle shall display a valid and current Shelter Island Town parking permit.
(3) 
There shall be no parking on the northwest side of Hiberry Lane commencing from the shoreline running southwest (landward) for 100 feet at any time that parking permits are in effect.
(4) 
There shall be no parking on Hiberry Lane between Point Lane and Dinah Rock Road at any time that parking permits are in effect.

Menantic Road; 100 feet on the east and west sides of New York Avenue from the West Neck Road and New York Avenue Intersection.

A. 
Except when necessary to avoid conflict with other traffic or when in compliance with law or the directions of a police officer or other personnel so authorized by the Town Board or official traffic control device, no person shall stop, stand or park a vehicle:
(1) 
On a sidewalk.
(2) 
Within an intersection, except when permitted by official signs or parking meters on the side of the highway opposite a street which intersects but does not cross such highway.
(3) 
On a crosswalk.
(4) 
Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.
(5) 
Upon any bridge or other elevated structure upon a highway, unless otherwise indicated by official signs or markings.
(6) 
Within 15 feet of a fire hydrant, except when such vehicle is attended by a licensed operator or chauffeur who is seated in the front seat and who can immediately move such vehicle in case of emergency, unless a different distance is indicated by official signs, markings or parking meters.
(7) 
On the roadway side of any vehicle stopped, standing or parked at the edge or curb of a street.
(8) 
When police have posted official signs prohibiting, restricting or limiting the stopping, standing or parking of vehicles, no person shall stop, stand or park any vehicle in violation of the restrictions stated on such signs.

B. 
Except where angle parking is authorized, every vehicle stopped, standing or parked wholly upon a two-way roadway shall be so stopped, standing or parked in the direction of authorized traffic movement with the right-hand wheels of such vehicle parallel to and within 12 inches of the right-hand curb or edge of the roadway.
C. 
Except where angle parking is authorized, every vehicle stopped, standing or parked wholly upon a one-way roadway shall be so stopped, standing or parked parallel to the curb or edge of the roadway, in the direction of authorized traffic movement, with its right-hand wheels within 12 inches of the right-hand curb or edge of the roadway or its left-hand wheels within 12 inches of the left-hand curb or edge of the roadway.
D. 
No person shall stop, stand or park a vehicle, whether occupied or not, in front of a public or private driveway, except momentarily to pick up or discharge a passenger or passengers.
E. 
It shall be a violation for any person to stop, stand or park a vehicle in any area designated as a place for handicapped parking, unless the vehicle bears a permit issued under Section 1203-a or a registration issued under Section 404-a of the Vehicle and Traffic Law, and such vehicle is being used for the transportation of a severely disabled or handicapped person.
F. 
No motor vehicle shall be parked upon any highway without first being inspected pursuant to the Vehicle and Traffic Law of the State of New York.

Any vehicle parked in violation of any provision of this chapter or any other law, ordinance, rule or regulation may be removed or caused to be removed by or at the direction of any police officer of the Town of Shelter Island and, after such removal, stored or caused to be stored in a suitable place at the expense of the owner. The owner or person in charge of such vehicle may redeem the same upon payment to the Shelter Island Town Police Department of the amount of all outstanding fines plus the actual and necessary expenses incurred in the removal and storage of such vehicle. The Shelter Island Police Department shall ascertain, to the extent possible, the owner or person in charge of such vehicle and shall notify them of the amount which will be required to redeem the same.

A. 
All motor vehicles or motorcycles using any parking areas designated as "Parking by Town Permit Only" as set forth in this chapter shall display a sticker which will be issued by the Town Clerk to domiciled residents of the Town of Shelter Island.
B. 
The regulations requiring Town-issued parking stickers shall be in effect 24 hours per day from May 15 through September 15 unless the Town Board shall establish, on its own motion, alternate hours of the day and dates on which a parking sticker shall be required.
C. 
There shall be open parking at locations otherwise marked as "Parking by Town Permit Only" at any time that parking permits are not in effect.
D. 
The Town Board shall establish, on its own motion, the fee to be charged for parking stickers issued on a daily, weekly, monthly and seasonal basis.
E. 
All permit types as defined below shall be acceptable for parking at any location where such permits are required.
F. 
Parking stickers shall be displayed on the driver's side bottom corner of the rear bumper of a motor vehicle or on the rear mudguard of a motorcycle.

A. 
Multi-year resident permits shall be available only to domiciliaries of the Town of Shelter Island, to include owners of real property and lessees, for a period of one year as well as their immediate families residing with them at their Shelter Island address.
B. 
Weekly, monthly and seasonal permits shall be available as follows:
(1) 
To domiciliaries for their out-of-town guests.
(2) 
To lessees of real property for a period of at least one week.
(3) 
To registered guests of Shelter Island hotels, inns, tourist cabins, rooming houses and bed-and-breakfasts. (Proprietors of these establishments may purchase parking stickers in quantity for the fee established by the Town Board for resale to residents of their establishment at the same fee.)
C. 
Daily parking permits shall be available to the general public, subject to the following:
(1)

(2) 
The number of daily parking permits shall be limited. The number of daily permits available each day shall be determined by the Town Supervisor in consultation with the Town Clerk, Chief of Police, Superintendent of Highways.
(3) 
Daily permits may be limited to use at particular locations to be determined by the Town Board.

The Town Board, on its own motion, may establish criteria to determine residency for the purpose of qualifying for parking permits.
A. 
Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop line, but, if none, then shall stop before entering the crosswalk on the near side of the intersection or, in the event that there is no crosswalk, at the point nearest the intersecting highway where the driver has a view of the approaching traffic on the intersecting highway before entering the intersection and shall yield the right-of-way to any vehicle which has entered the intersection from another highway or which is approaching so closely on said highway as to constitute an immediate hazard.
B. 
Except when directed to proceed by a police officer, every driver of a vehicle approaching a yield sign shall, in obedience to such sign, slow down to a speed reasonable for existing conditions or shall stop, if required for safety, in the manner provided in the preceding subsection and shall yield the right-of-way to any vehicle in the intersection or approaching another highway so closely as to constitute an immediate hazard.
C. 
The foregoing provisions of this section shall not apply to the driver of an authorized emergency vehicle when responding to an emergency call or when in the pursuit of an actual or suspected violator of the law or when responding to, but not upon returning from, a fire alarm, provided that such emergency vehicle, except a police vehicle, shall sound an audible signal by bell, siren or whistle and display a red light, and provided further that the driver of such vehicle, when approaching a stop or yield intersection, shall slow down sufficiently to assure the safety of other highway users and the safe operation of such vehicle.
D. 
The system of traffic markings upon the New York State highways is hereby made applicable to the Town roads in the Town of Shelter Island. Said markings, when placed upon Town roads, shall have the same meaning and effect as similar markings upon state roads in this Town, and violations of such markings upon said Town roads shall be subject to the same penalties as violations of such markings on state roads.

The maximum speed at which vehicles may proceed on or along any streets within the area known as the "area of the Shelter Island Heights Property Owners' Corporation" is hereby established at 25 miles per hour.

Any vehicle registered with a gross vehicle weight rating or a gross combination weight rating of more than nine tons shall be excluded from New York Avenue, Serpentine Drive and the unpaved portions of Sunnyside Avenue. Such exclusion shall not be construed to prevent the delivery or pickup of merchandise or other property on New York Avenue, Serpentine Drive and the unpaved portions of Sunnyside Avenue or to prevent traffic from going to and from residences and businesses located on New York Avenue, Serpentine Drive and the unpaved portions of Sunnyside Avenue.
B. 
Sufficient signage shall be erected in locations that will ensure that overweight vehicles have the opportunity to divert to alternate routes.

B. 
A violation of any other provision of this chapter shall be deemed a traffic infraction and shall be punishable as follows:
(1) 
For a first conviction thereof, by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
(2) 
For a second conviction within 18 months thereafter, by a fine of not more than $200 or by imprisonment for not more than 45 days, or by both such fine and imprisonment.
(3) 
For a third or subsequent conviction within 18 months after the first conviction, by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.
