No person, firm or corporation shall carry on, conduct or operate
within the Village of Webster, New York, a circus, sideshow or other
outdoor exhibition without first having obtained a license issued
by the Code Enforcement Officer and countersigned by the Village Clerk
therefor, and it shall be unlawful for any person, firm or corporation
to carry on, conduct or operate within said Village a circus, sideshow
or other outdoor exhibition without first having obtained a license
therefor.
The fee for such license shall be set from time to time by the
Village Board.[1]

A.ย
Any person,
firm or corporation violating this article shall be liable to a penalty
not exceeding $250 or imprisonment not exceeding 15 days, or both,
for each violation thereof.

Action
to recover penalties. An action may be maintained by the Village to
recover a penalty imposed for a violation of this article, and in
such action an order of arrest may be issued and executed in the manner
prescribed by the Uniform Justice Court Act for orders of arrest in
justice courts. In such action it shall be lawful to declare or complain
generally for such penalty, stating the section of this article under
which the penalty is claimed and briefly setting forth the alleged
violation.
