A violation of the provisions of Articles VI to XII of this Part 2 or the rules and regulations adopted by the Village of Webster authorized by Articles VI to XII shall be subject to a penalty not to exceed $10,000 for any one case and an additional penalty not to exceed $10,000 for each day of a continuing violation after a final decision and order has been entered with notice to the party adversely affected by the decision to impose the penalty. The exact amount of penalty in each case shall be determined by the Village Board of the Village of Webster and in no case shall be less than $300 per day.

The penalty shall become part of the Village of Webster charges and
shall be collected as a charge in accordance with the County Law of
New York.

In enforcing against violations of this Part 2 or permits issued thereunder, the Superintendent and the Village Board shall employ the administrative procedure under § 113-58, which sets forth the Village of Webster enforcement policy and procedures. The Superintendent shall assist appropriate state and federal agencies, as necessary, in their review of or action against violators.

Whenever it appears that any person is violating or threatening to
violate any provision of this Part 2 or any decision of the Village
Board or any duly issued order of the Superintendent, the Village
Board may authorize suit in the name of the Village against such person
in any court of competent jurisdiction to restrain such person from
continuing such violation or from carrying out the threat of violation.
The Village Board may direct an action for an injunction against any
person violating or threatening to violate any provision of this Part
2 or any of the decisions of the Village Board or any duly issued
order of the Superintendent. However, in the event of an emergency
situation in which time, in the opinion of the Mayor, does not allow
the awaiting of a Board meeting, the Mayor may order an immediate
action for a temporary court injunction pending formal Board approval
at the Board's subsequent meeting.

Proceedings under this Part 2 do not preclude enforcement of any
ordinances, criminal statutes or laws of the State of New York by
either the Village of Webster or the State of New York.
