The purpose of this chapter is to promote the health, safety and general welfare of the Village of Webster, to regulate and enforce regulations concerning the use of skateboards, skates (roller/inline), and scooters within the Village and to control the construction of skateboard ramps to ensure that the operation of skateboard ramps will not interfere with the quiet enjoyment of property owners within the Village.
As used in this chapter, the following terms shall have the meanings indicated:
IN-LINE SKATES
Shoes, skates, or footwear with a single row of roller wheels.[1]
ROLLER SKATES
Shoes, skates, or footwear with two or more sets of roller wheels.[2]
SCOOTER
A narrow board of wood, plastic, fiberglass or similar material with roller skates or other types of wheels attached to each end with a steering rod that is attached to the front wheels to allow for maneuvering.
SKATEBOARD
A single platform which is mounted on wheels, having no self-contained mechanism or other devices with which to steer or control the direction of movement thereof while being used, operated or ridden.
SKATEBOARD RAMP
Any structure or improvement located on private property which is used for the purpose of riding or propelling skateboards, motorcycles, motorized bicycles, trail bicycles or roller skates.

A. 
No person shall use, operate or ride upon any skateboard in any of the following areas:
(1) 
Any public park in the Village of Webster.
(2) 
Any public parking lot or public parking garage in the Village of Webster.
(3) 
On Main Street, including sidewalks between Phillips Road and Barrett Drive.
(4) 
On South Avenue, including sidewalks between Main Street and Park Avenue.
(5) 
On North Avenue, including sidewalks between Main Street and New York State Route 104.
(6) 
On private property without the owner's permission.
B. 
Further, no person shall use, operate or ride on any skateboard, scooter, or skates (roller/inline) in any place within the Village of Webster in a manner to create a nuisance or in such an unsafe or dangerous manner as to put himself/herself or others in danger of death or serious bodily injury.
A. 
Skate ramps shall be prohibited:
(1) 
Within any right-of-way or private roadway.
(2) 
In any location forward of the rear or the building line, as extended, of the principal structure upon a particular lot, except in the case of a portable skateboard ramp less than three feet in height.[1]

B. 
No skateboard ramp shall be in excess of six feet in height. Skateboard ramp use must comply with all current or future noise ordinances.[2]

C. 
Skateboard ramps must comply with all minimum rear yard and side yard zoning setback requirements.
D. 
Skateboard ramps shall be used only between the hours of 8:00 a.m. and 10:00 p.m.
A. 
Any police officer who shall observe any person using, operating or riding upon a skateboard, scooter, and skates (roller/inline) in violation of this chapter may take possession of the skateboard, scooter and/or skates (roller/inline). In the case of a first offense, the skateboards, scooters and skates (inline/roller) will be returned to the rider at the Webster Police Station upon the appearance of the rider, if the rider is 18 years or older, or an appearance there of the rider accompanied by his or her parent or guardian, if the rider is under the age of 18 years. In the case of a second offense, the, skateboards, scooters and skates (inline/roller) shall be taken from the rider and not returned to him or her for a period of 15 days and not returned until the appearance at the Webster Police Station as aforesaid. In the case of a third offense, the skateboards, scooters and skates (inline/roller) shall be taken from the rider for a period of 60 days and not returned until appearance at the Webster Police Station. In the case of any further offenses, the skateboards, scooters and skates (inline/roller) shall be taken from the rider, forfeited to the Village of Webster and destroyed.
B. 
A person who violates any regulation under this chapter or who continues to work on, operate or use a skateboard ramp after service of such notice, in writing, from the Building Inspector to discontinue such activities shall forfeit and pay a fine of not more than $250 or be subject to imprisonment for not more than 15 days, or both, for each offense. Each week any such violation continues unresolved shall constitute a separate offense.
