The purpose of this chapter is to regulate and control the use of snowmobiles within the corporate limits of the Village of Webster, to provide for the safe and proper use of snowmobiles within the Village and to minimize the detrimental effects of their use upon the community and upon the environment.

The use of snowmobiles within the corporate limits of the Village of Webster shall be governed by the Parks, Recreation and Historic Preservation Law of the State of New York and any other applicable law, except as otherwise provided herein. This chapter is enacted pursuant to the authority conferred by § 25.09 of the Parks, Recreation and Historic Preservation Law.
A. 
The use of snowmobiles on all highways and roadways shall be governed by the Parks, Recreation and Historic Preservation Law.
B. 
"Use" shall mean to ride in or on, other than as a passenger, or operate or control the operation of a snowmobile in any manner, whether or not it is in motion.
C. 
The definitions contained in § 21.05 of the Parks, Recreation and Historic Preservation Law shall apply to this chapter.
A. 
Snowmobiles may be used on private property only with the consent of the owner or lessor thereof.
B. 
Snowmobiles may not be used on any Village playground areas.
Snowmobiles may be used on sidewalks only to cross such sidewalks in order to cross streets or highways and shall stop and yield the right-of-way to any other users of the sidewalks.
No snowmobile shall be used in the Business District of the Village unless an emergency has been declared by a duly authorized state, county, town or Village official. For the purposes of this chapter, the Business District is that area zoned as Central Business as depicted on the Official Zoning Map of the Village of Webster as filed in accordance with §175-5C.

No person shall operate a snowmobile except on private lands at a speed greater than 10 miles per hour.
No person under the age of 18 shall operate a snowmobile except as provided in § 25.19, Operation by Youthful Operators, of the Parks, Recreation and Historic Preservation Law.

Any person who violates the provisions of this chapter shall be guilty of a traffic infraction or of a violation, as such terms are used in Article 27 of the Parks, Recreation and Historic Preservation Law, and shall be punishable as provided in said Article 27, and shall be fined a minimum of $10.
