The Comprehensive Plan of the Town of Westerly, fully titled as "Town of Westerly, Rhode Island, Comprehensive Community Plan 2020-2040" (hereafter "The Comprehensive Plan"), as duly adopted by the Town Council on January 20, 2021, in accordance with the Rhode Island Comprehensive Planning and Land Use Act, RIGL § 45-22.2 et seq., is incorporated by reference in its entirety within Chapter 10 of the Westerly Code of Ordinances.
All previous comprehensive plans for the Town of Westerly are
repealed upon adoption of The Comprehensive Plan.
A.Â
A comprehensive plan is adopted, for the purpose of conforming municipal
land use decisions and for the purpose of being transmitted to the
chief for state review, when it has been incorporated by reference
into the municipal code of ordinances by the legislative body of the
municipality. All ordinances dealing with the adoption of or amendment
to a municipal comprehensive plan shall contain language stating that
the comprehensive plan ordinance or amendment shall not become effective
for the purposes of guiding state agency actions until it is approved
by the State of Rhode Island pursuant to any rules and regulations
adopted pursuant to RIGL 45-22.2 et seq. a/k/a The Rhode Island Comprehensive
Planning and Land Use Act. The comprehensive plan of a municipality
shall not take effect for the purposes of guiding state agency actions
until approved by the Rhode Island Division of Statewide Planning.

The Comprehensive Plan shall take full effect once approved by the
Rhode Island Division of Statewide Planning.

As required by RIGL 45-22.2 et seq., The Comprehensive Plan, including
all appendices and maps, and supplements to the extent they exist,
as well as any proposed amendments going forward, shall be kept and
made available for public review by the Town Clerk and by the Town
Planner (if authorized in writing by the Town Clerk). The Comprehensive
Plan shall be available for public review in print, digitally and
will be placed on the internet.

The Town Clerk or the Town Planner (if authorized in writing by the
Town Clerk), shall have the sole responsibility to insert, in appropriate,
designated places, all amendments to The Comprehensive Plan upon adoption
of any amendments pursuant to 10-4 of this Ordinance and RIGL 45-22.2
et seq.
C.Â
To account for changing conditions across the Town of Westerly, the
Town Staff and appropriate Boards, Commissions and the Town Council
shall periodically review The Comprehensive Plan. Any subsequent amendments
shall be made in a timely manner.
D.Â
The Town of Westerly shall file an informational report on the status
of The Comprehensive Plan's implementation program to the Statewide
Division of Planning not more than five years after its adoption by
the Town Council.
