The chief law enforcement officer of the Town of Fulton shall be known as the "Chief of Police." Wisconsin Statutes and Town of Fulton ordinances also refer to the chief law enforcement officer as "Constable." For the purpose of this article and the other ordinances of the Town of Fulton, these terms are interchangeable and the powers and duties delegated to the Constable shall be deemed delegated to the Chief of Police.
The Town Board of the Town of Fulton does have the authority to establish the powers and duties of the Town Chief of Police of the Town of Fulton because the Town Meeting did abolish the office of Town Constable and did create or recreate the office of Town Chief of Police.
The Town Board of the Town of Fulton has, by adoption of this article, confirmed the statutory authority, powers and duties noted above in Ch. 60, Wis. Stats., and has established, pursuant to that chapter and this article, other statutory authority, powers and duties of the Town Chief of Police of the Town of Fulton.
The Chief of Police of the Town of Fulton shall:
A. 
Keep the peace within the Town of Fulton and have the full peace powers to arrest and apprehend any person for felony or breach of peace pursuant to § 59.28, Wis. Stats., and for purposes of carrying out such duties shall be considered a peace officer as defined in § 939.22(22), Wis. Stats.
B. 
Direct and regulate traffic and make arrests for violation of traffic crimes and regulations of Chs. 194 and 341 to 349, Wis. Stats., and any Town of Fulton ordinances in conformity with these chapters and for purposes of carrying out such duties shall be considered a traffic officer as defined in § 340.01(70), Wis. Stats.
C. 
Have the power to issue citations for the violation of any Town of Fulton ordinances.
D. 
Serve within the County of Rock any writ, process, order or notice and execute any order, warrant or execution lawfully directed to or required to be executed by him by any court or officer.
E. 
Attend open sessions of the Circuit Court in the County of Rock when required by the Sheriff.
F. 
Impound cattle, horses, sheep, swine and other animals at large on the highways in violation of any duly published order or ordinance adopted by the Town Board of the Town of Fulton.
G. 
Cause to be prosecuted all violations of law of which he or she has knowledge or information.
H. 
Perform all other duties required by any law.
I. 
Cause to be enforced and prosecuted all violations of the Town of Fulton Town ordinances of which he or she has knowledge or information.
J. 
Act on behalf of the Town Board of the Town of Fulton as directed to:
(1) 
See that orders of the Town Board of the Town of Fulton and ordinances of the Town of Fulton are obeyed.
(2) 
See that peace and order are maintained in the Town of Fulton.
(3) 
Obtain necessary assistance, if available, in case of emergency, except as provided under Ch. 166, Wis. Stats., for emergency government.
A. 
Other ordinance. Adoption of this article does not preclude the Town Board of the Town of Fulton from adopting any other ordinance or providing for the enforcement of any other law or ordinance relating to the same or other matter.
B. 
Other remedies. The jurisdiction, powers and duties of the Chief of Police of the Town of Fulton as stated herein shall not preclude the Town Board of the Town of Fulton or any other Town officer of the Town of Fulton from proceeding under any ordinance or law or by any other enforcement method to enforce any ordinance, regulation or order.
