The Town Board of the Town of Fulton has the
specific statutory authority, powers and duties, pursuant to §§ 60.20,
60.22 and 60.31, Wis. Stats., to require that certain elected officials
take an official oath and to require that they file the appropriate
bond.
A.
General provision. All elected officers and appointed
officers of the Town of Fulton shall take and file the below-noted
oath within five days after notification of election or appointment
by the Town Clerk/Treasurer of the Town of Fulton. The written oath
of office and the oral oath of office shall be in the form prescribed
by § 19.01, Wis. Stats.

B.
Filing locations. The official oath of all elected
officers and appointed officers of the Town of Fulton shall be filed
with the Town Clerk/Treasurer of the Town of Fulton.
C.
Failure to file oath. If any elected officer or appointed
officer of the Town of Fulton fails to file the proper oath within
the time prescribed by statute, the failure to file constitutes refusal
to serve in the office. No Municipal Judge in the Town of Fulton shall
be paid a salary for any time during the term during which the Municipal
Judge has not executed and filed his or her oath.

(1)
The following officers of the Town of Fulton shall
be required to execute and file an appropriate bond. The amount of
the bond shall be as established by Wisconsin law or as established,
from time to time, by the Town Board. These officers are: Town Clerk/Treasurer,
Town Chief of Police, Building Inspector, and, if so elected, the
Municipal Judge.

The bond costs shall be provided by the Town of Fulton.
No natural person may be a surety on a bond. The bond may be furnished
by a surety company under § 632.17(2), Wis. Stats. The Town
Board of the Town of Fulton has, by this article, established the
amounts of the bonds. The Town Board of the Town of Fulton shall establish
the amount of the bonds, which amounts shall be on file at the office
of the Town Clerk/Treasurer of the Town of Fulton. The Town Board
of the Town of Fulton may at any time determine that any bond amount
noted above is insufficient or in excess and may therefore require
an officer noted above to file a new bond within 10 days in an amount
fixed by the Town Board of the Town of Fulton.

Pursuant to § 70.67(2), Wis. Stats., the
Town shall pay, in case the Clerk/Treasurer fails to do so, all taxes
of any kind required by law to be paid by the Clerk/Treasurer to the
County Treasurer.
B.
Filing location. The official bond shall be filed
with the Town Clerk/Treasurer of the Town of Fulton, except that the
Municipal Judge shall file his or her bond with the Clerk of Circuit
Court for the County of Rock.

C.
Failure to file bond. The Town Board of the Town of
Fulton may refuse to pay wages or salaries to any Town of Fulton employee
or Town of Fulton officer requested to post bonds until the proper
bond is filed with the Town Clerk/Treasurer of the Town of Fulton.
If the Town of Fulton employee fails to post the appropriate bond
within 10 days of written request by the Town Board of the Town of
Fulton, the failure to file the requested bond constitutes refusal
to serve in office and the office can be declared vacant by the Town
Board of the Town of Fulton.
