[HISTORY: Adopted by the Village Board of the Village of Shorewood as Ch. 3, Art. 12 and Ch. 13, Art. 4 and § 13-1703 of the 1986 Code. Amendments noted where applicable.]
The Shorewood Public Library is hereby created as provided under Ch. 43, Wis. Stats. The Library shall be administered by a Library Board which shall appoint a librarian known as the "Director of Library Services."
The Director of Library Services shall appoint such other assistants and employees as the Library Board deems necessary and prescribe their duties and compensation, subject to Village budgetary limitations. The Director shall be responsible for supervising all library services and activities provided by the Library.
A. 
Membership and term. The Library Board shall consist of seven members. Members shall be residents of the Village. Members shall be appointed by the Village President with the approval of the Village Board. Upon their first appointment, the members shall be divided as nearly as practicable into three equal groups to serve two-, three- and four-year terms respectively. Thereafter each regular appointment shall be for a term of three years. Vacancies shall be filled for unexpired terms in the same manner as regular appointments are made. Members shall serve until their successors are appointed. One member appointed to the Board shall be a school district administrator or his/her representative. Not more than one member of the Village Board shall at any one time be a member of the Library Board. Terms shall commence June 1.

B. 
Compensation. No compensation shall be paid to members of the Library Board for their services except as follows:
(1) 
Members may be reimbursed for their actual and necessary expenses incurred in performing duties outside the Village if so authorized by the Library Board.
(2) 
Members may receive per diem, mileage and other necessary expenses incurred in performing their duties if so authorized by the Library Board and the Village Board.

C. 
Quorum. A majority of the membership of the Library Board shall constitute a quorum.
D. 
Powers and duties. The powers and duties of the Library Board shall be as provided in § 43.58, Wis. Stats.
E. 
Organization. As soon as practicable after the first appointments, at a date and place fixed by the Village President, and annually thereafter, the members of the Library Board shall elect a President and such other officers as they deem necessary.
F. 
Meetings. The Library Board shall meet at the call of the Director of Library Services or the President of the Board at such times as they deem it necessary.
G. 
Rules and regulations. The Library shall be free for the use of residents of the Village subject to such reasonable regulations as the Library Board prescribes in order to render its use most beneficial to the greatest number. The Library Board may exclude from the use of the Public Library all persons who willfully violate such regulations. The provisions of § 350-4 of this chapter shall govern overdue fines, charges and regulations with regard to return of library property.[1]

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
LIBRARY
The Shorewood Public Library.
LIBRARY MATERIAL
Includes all books, periodicals, pamphlets, records, tapes, disks, photographs, documents, artifacts, or other documentary, written or printed materials, regardless of the physical form or characteristics, belonging to, on loan to or otherwise in the custody of the Shorewood Public Library.
B. 
Return of property. All library materials shall be returned in reasonably good condition and in accordance with the rules and regulations established by the Shorewood Public Library. Any person who borrows library materials from the Shorewood Public Library and who fails to return them in the same condition as when borrowed or who fails to return library material after the due date as prescribed by the rules and regulations of the Shorewood Public Library shall be liable for the cost of the replacement for the library material and further subject to penalties as set forth in this section.
C. 
Theft and damage.
(1) 
Theft. Any person who shall intentionally take, carry away, transfer, conceal or retain possession of any library material contrary to the rules and regulations established by the Shorewood Public Library or without the consent of a library official, agent or employee and with the intent to deprive the library of possession of the material shall be subject to the penalties as set forth in this section.
(2) 
Damage. Any person who shall mar, deface or cause physical damage to any library material without the consent of a library official, agent or employee shall be subject to penalties as provided within this section.[1]

D. 
Penalties. In addition to any liability for the cost of replacement of library materials and any fines, penalties, charges or loss of privileges as established by the Shorewood Public Library, any person who shall be found guilty of violating provisions of Subsection B or C shall be subject to penalties and forfeitures as provided in § 350-5.

Except where a penalty is otherwise prescribed, the penalty for violation of any provision of this chapter shall be as set forth in § 115-1 of the Village Code.
