Every hotel and motel in the Borough of Rockaway shall be required to maintain at all times a registry identifying the name of each occupant of each rooming unit, together with the principal residence address of each occupant and the date upon which his or her occupancy of such rooming unit commenced, which registry shall be signed by the person renting the room. Such registry shall include identification of each occupant which must be kept on file and subject to review by the Zoning Officer or designee of the Borough of Rockaway upon periodic inspections.
No person shall occupy a hotel, motel or multiple-dwelling establishment for more than 90 days, nor shall any person extend his or her stay for longer than 90 days by moving into another unit within the same establishment. All rentals must be on a daily or weekly basis.
Any owner of any hotel or motel found to be in violation of this chapter will be subject to the following fines and penalties:
A. 
First offense: not less than $50 up to $200 per day for every day the occupancy is exceeded.
B. 
Second offense: not less than $100 up to $400 per day for every day the occupancy is exceeded.
C. 
Third offense: not less than $250 up to $750 per day for every day the occupancy is exceeded.
D. 
Fourth offense: not less than $500 up to $1,000 per day for every day the occupancy is exceeded.
E. 
Each offense thereafter: imprisonment for a term not to exceed six months or a period of community service not to exceed 90 days.
