Connection to the central alarm system may be
made only by such person, corporations or governmental units as own
or operate within the Village of Springville a facility having, in
the sole discretion of the Board of Trustees, a clear and compelling
need therefor; provided, however, that such Board of Trustees, in
its sole discretion, may permit connection by a governmental unit
or public-service organization for a facility owned or operated by
it within the Town of Concord. No such connection shall be permitted
until the company then servicing and maintaining the equipment constituting
such central alarm system shall certify to the Board of Trustees the
feasibility of such connection.
A.
The entire cost of installation of any connection
to the central alarm system shall be borne by the applicant. Thereafter,
the entire cost of any subsequent modification, alteration or removal
shall, in like manner, be borne by the user.
B.
The annual cost of inspection of each connection point
shall be at the expense of the user, to be paid as herein provided.

In addition, there is also hereby imposed an annual
permit fee for each board point, in an amount to be fixed from time
to time by the Board of Trustees, which shall in no event be less
than the amount set from time to time by resolution of the Board of
Trustees. The annual permit fee for each board point for any facility
located outside the Village of Springville shall be 150% of the fee
hereinabove imposed. Such fee shall be payable in advance on the first
day of May in each year and shall, in the year of installation, be
prorated for the number of months remaining in such permit year after
the date of installation.

C.
There is also hereby imposed an annual inspection
fee for each board point, in an amount to be fixed from time to time
by the Board of Trustees, which shall be payable on the first day
of May in each year.
D.
The Board of Trustees, in its sole discretion, may
waive any or all of the charges and fees imposed by this section in
the case of a Police Department of the Village of Springville, Town
of Concord or County of Erie or a public-service organization located
entirely within the Village of Springville.
A.
Application for a permit for connection to a board
point in the central alarm system shall be made, in writing, to the
Village Clerk on such form as he shall prescribe, accompanied by the
installation charge as set forth from time to time by resolution of
the Board of Trustees. In the event that such application shall be
denied by the Board of Trustees, such charge shall be refunded to
the applicant.

B.
Any permit issued hereunder may at any time be revoked
by the Board of Trustees for the violation of or noncompliance with
any provision of this article, including but not limited to nonpayment
of the charges and fees imposed hereby, or for any false statement
made in the application therefor. In the event of such revocation,
any charges or fees theretofore paid to the Village of Springville
hereunder shall be forfeited to said Village as a penalty for such
violation or noncompliance, as the case may be.

The purpose of this section is to protect and
promote the health, safety and general welfare within the boundaries
of the Village of Springville by reducing the number of false alarms
of fire, intrusion, robbery or other criminal activity, or medical
emergency which contribute to the ineffective use of emergency response
agencies, require emergency responses which are themselves susceptible
to high accident rates, interfere with response to genuine emergencies
and produce unnecessary alarm noise and social confusion in the surrounding
area.
As used in this section, the following terms
shall have the meanings indicated:
Any assembly of equipment or devices arranged to signal the
presence of a hazard requiring urgent attention which is directly
or indirectly connected to police, fire or emergency medical services
and to which police, fire or emergency medical service agencies are
expected to respond.
New York State Department of State Licensed Alarm Provider.
Activation of an alarm system which is not caused by, or
the result of, an actual emergency situation such as robbery, intrusion
or other criminal activity, fire or medical emergency.
Village of Springville Volunteer Fire Department.
All occupancies not categorized herein as residential.
Village of Springville Police Department, Erie County Sheriff's
Department and New York State Police.
One- and two-family occupancies as defined in this Code.
Village of Springville.
The responding Fire Department or Police Department
shall inform the alarm user of the false alarm fees provided in this
section at the time of the false alarm, although failure to do so
shall not invalidate the imposition of a false alarm fee.
A false alarm fee schedule shall be established
by resolution of the Village's Board of Trustees, and the Village
Clerk shall impose the appropriate fee upon the alarm system owner
in accordance with that schedule. Such fee schedule may thereafter
be amended from time to time by like resolution. Fees may differ between
residential and nonresidential occupancies and may be increased for
a second and subsequent false alarms actuated within a moving period
of 365 days.
The amount of a false alarm fee shall be determined
by the number of false alarms actuated within a moving period of 365
days. If, however, an authorized technician services the system that
generated a false alarm within two business days after that false
alarm; and if all discoverable deficiencies are corrected within five
business days from the date an authorized technician services the
system, unless otherwise extended by the Village Code Enforcement
Officer; and if written verification of such correction is immediately
submitted to the Village Clerk by the authorized technician, that
or those false alarm(s) shall not be counted for purposes of the imposition
of a false alarm fee.
If the Village Clerk is not in receipt of written
verification of such correction within 10 business days from the date
of the false alarm, then written notice assessing a false alarm fee
will be sent to the alarm user. In the event that the Village Code
Enforcement Officer has extended the alarm user's time frame to correct
the discovered deficiencies, then the Village Clerk will send a written
notice assessing a false alarm fee three business days after the time
frame granted to correct the deficiency by the Village Code Enforcement
Officer if written verification of the correction is not received.
Failure to pay a false alarm fee imposed by the Village Clerk within 30 days of written notice from the Village Clerk shall be considered a violation of this section and upon conviction thereof shall be punishable as provided in Article II, General Penalty, of Chapter 1 of the Code of the Village of Springville. The penalty for failure to pay the false alarm fee within 30 days shall be in addition to the false alarm fee imposed by this section.
