GENERAL REFERENCES
Land use and development — See Ch. 170.
As used in this chapter, the following terms shall have the meanings indicated:
UNIT OF DWELLING SPACE
Any room or rooms, or suite or apartment thereof, whether furnished or unfurnished, which is occupied or intended, arranged or designed to be occupied for sleeping or dwelling purposes by one or more persons, provided that this definition shall not be construed to include:
A. 
Any rooming house or boardinghouse as defined by the Rooming and Boarding House Act of 1979, N.J.S.A. 55:13B-1 et seq.
B. 
Any hotel, motor hotel, motel or established guesthouse which is commonly regarded as a hotel, motor hotel, motel or established guesthouse; however this section is limited to a hotel, motor hotel, motel or established guesthouse which contains at least 10 or more units of dwelling space or has sleeping facilities for at least 25 or more persons and is kept, used, maintained, advertised as or held out to be a place where sleeping or dwelling accommodations are available to transient or permanent guests.
A. 
No person shall rent, lease or let to any occupant or occupants, whether or not for consideration, any unit of dwelling space unless a housing permit has been obtained from the City of Egg Harbor City. The housing permit shall be valid for a period of one year and shall be on a form prepared by the City of Egg Harbor City. The housing permit shall be posted on the interior door of the entrance to the unit of dwelling space.
B. 
The owner of record of the property in question, regardless of an individual, partnership, firm and/or corporation, shall be responsible to renew the housing permit annually.

The housing permit referred to in § 161-2 shall not be issued by the City of Egg Harbor City unless the following conditions are satisfied:
A. 
An inspection fee in the amount of $75 per year is paid to the City of Egg Harbor. Said fee shall be paid no later than June 30 of each year. If not paid by June 30, the application fee shall be $100, in addition to any sanctions imposed hereafter in § 161-5. Fees are subject to revision by resolution of the City Council of the City of Egg Harbor.

B. 
The owner of the building in which a unit of dwelling space is situated has, upon a form provided by the City of Egg Harbor, registered said premises and designated thereon the name and address of the owner and the name and address of the resident and/or individual charged with responsibility of the maintenance of said property and the names and addresses of the lessors of the property.
No tenant or occupant of any unit of dwelling space shall sublease, sublet or permit use of the unit of dwelling space without complying with the provisions of this chapter.
Any individual, partnership, firm and/or corporation violating the provisions of this chapter shall, upon conviction thereof, be subject, for the first offense, to a fine of not less than $50 nor more than $250. For a second offense, an individual, partnership, firm and/or corporation shall be subject to a fine of not less than $100 nor more than $500. For a third or subsequent offense, an individual, partnership, firm and/or corporation shall be subject to a fine of not less than $250 nor more than $1,000 or be imprisoned in the county jail for a period not to exceed six months.
This chapter shall be in addition to any and all requirements of obtaining a certificate of occupancy, a certificate of continuing occupancy, an occupancy transfer certificate and any and all applicable permits and/or certificates as required by law.

All residential rental properties are subject to an annual inspection by an Egg Harbor City Code Official. The Code Official is authorized to enter the premises at reasonable times to inspect. The Code Official shall carry proper identification when inspecting premises.
