A. 
Under the supervision of the Mayor as chief executive, there shall be a Department of Municipal Administration. Within the Department there shall be the following divisions:
(1) 
Division of Municipal Operations.
(2) 
Division of Law.
(3) 
Division of Administration.

B. 
Departmental powers and duties generally. The Department shall assist the Mayor in the direction and supervision of the departments established by this chapter; coordinate the operation and administration of the various departments and agencies of the Township government; conduct the business operations of the Township; and perform such other duties as the Mayor may designate. With respect to the statutory agencies herein designated, the Department shall have the authority of liaison between such agencies and the departments herein established.
Within the Department there shall be a Division of Municipal Operations, the head of which shall be the Municipal Clerk. The Division shall include such other personnel as shall be authorized by ordinance.
A. 
The Office of Municipal Clerk; composition. The office of Municipal Clerk shall consist of the Municipal Clerk and Deputy Municipal Clerk, who shall be appointed in the same manner and for the same term as herein prescribed for department heads pursuant to N.J.S.A. 40A:9-133, and such other personnel as may be authorized by ordinance. The Municipal Clerk shall be the chief clerical employee of the Township.
B. 
Powers and duties. Under the supervision of the Clerk, the Division shall:
(1) 
Maintain operating reports of the various departments, divisions, offices and agencies of the municipal government.
(2) 
Collect, report upon and turn over to the Treasurer all fees for which no other collection procedures are established by general law or by this chapter.
(3) 
Maintain records of ordinances and resolutions of the Council.
(4) 
Assist the Mayor in coordinating the operation and administration of the Department herein established.
(5) 
Perform such other duties as may be prescribed.
C. 
Duties and powers of Clerk.
(1) 
The Clerk shall be the Clerk of Council, attend all meetings of Council, perform such functions as may be required by law of municipal clerks in general and perform such other duties as may be prescribed for the Clerk of the Council by Article II of this chapter.
(2) 
The Clerk shall:
(a) 
Record all ordinances and resolutions adopted by the Council and, at the close of each year, with the advice and assistance of the Municipal Attorney, bind, compile or codify all the ordinances and resolutions or true copies thereof of the municipality which then remain in force and effect.
(b) 
Properly index the record books, compilation or codification of ordinances and resolutions.
(c) 
Promulgate and implement, with the approval of the Mayor, sound administrative, personnel and purchasing practices and procedures.
(d) 
Provide secretarial and clerical services for the Mayor and Council members.
(e) 
Prepare a copy of all ordinances and proposed ordinances which will require publication under the Charter or general law and cause the same, properly attested, to be published in any newspaper legally qualified for the publication of official advertisements and file in his office the requisite proofs of such publication.
(f) 
Issue all licenses and permits and collect all fees for which no other provision has been made by this chapter.
(g) 
Have custody of the Township Seal and affix it to such books, papers and documents as may be authorized pursuant to law.
(h) 
Have and take custody of all official books, papers and documents of the Township for which no other repository is provided by the Charter or ordinance and preserve and keep them safely.
(i) 
Prepare an annual directory of Township officials and employees.
(j) 
Be responsible for the purchase, maintenance, replacement and safekeeping of all office furniture, equipment and supplies of the Township for which no other provisions are herein made.
(k) 
Maintain use records of the equipment and facilities under his custody, an inventory of supplies and a replacement schedule of equipment and facilities.
(l) 
Perform the duties of Voting Registrar as provided by law.
(m) 
Be the depository and custodian of all official surety bonds furnished by or on account of any Township officer or employee, except his own bond, which shall be placed in the custody of the Township Treasurer; all insurance policies upon or with respect to risks insured for the benefit of the Township or to protect it against any claims, demands or liability whatsoever; and all formal contracts for work, labor, services, supplies, equipment and materials to which the Township may be a party. The Clerk shall also have custody of all leases of property owned by the Township and shall be the depository for and have custody of all performance bonds running to the Township as obligee and other forms of noncash security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the Township.
D. 
Deputy Clerk.
(1) 
The office of the Deputy Clerk is hereby created in and for the Township of Logan pursuant to the provisions of this section. The Deputy Clerk shall devote his full time and attention to the duties of his office and shall be bonded, at the expense of the Township, for the faithful performance of his duties.
(2) 
The Deputy Clerk shall have clerical and administrative experience.

(3) 
The Deputy Clerk shall receive as salary such sum as may be fixed by the annual Salary Ordinance of the Township.[1]

(4) 
The Deputy Clerk shall work under the direction of the Municipal Clerk. He shall perform all clerical or administrative functions assigned to him by the Municipal Clerk or the Mayor. The Deputy Clerk shall also perform those duties assigned to him by the members of Council in coordination with the Municipal Clerk.
(5) 
In the absence of the Municipal Clerk, the Deputy Clerk shall fulfill the duties of Municipal Clerk.
(6) 
Nothing in this section shall derogate from or authorize the Deputy Clerk to exercise the powers and duties of the elected and appointed officials and employees.
(7) 
Notwithstanding the fact that reference to this office holder is in the masculine pronoun, the office may be held by either a male or a female.
E. 
Personnel. The Division shall supervise the hiring policy of the Township as herein established and shall receive and distribute applications for employment, schedule interviews and maintain personnel files and records for all employees of the Township.
Within the Department there shall be a Division of Law under the direction of the Township Attorney who shall be appointed by the Mayor with the advice and consent of Council for a term of one year, within the limits of available appropriations. Prior to his appointment, he shall have been duly admitted to the practice of law in the State of New Jersey for at least three years.
A. 
The Township Attorney shall represent the Township in all legal matters and shall advise and assist the Mayor, the Council and the Department as required in the administration of the Township government. He shall attend meetings of the Council, draft ordinances and resolutions and give opinions and rulings on questions of law which may arise at Council meetings. He shall prepare or approve all legal instruments relating to the business of the Township. He shall represent the Township in any litigation and conduct trials, appeals and other proceedings affecting the interest of the Township as he may, in his discretion, determine to be necessary or desirable or as directed by the Mayor or Council.
B. 
Additional duties. The Township Attorney shall also:
(1) 
Maintain records of all actions, suits, proceedings and matters which relate to the Township's interest and report thereon, from time to time, as the Mayor or Council may require.
(2) 
Have power to enter into any agreement, compromise or settlement of any litigation in which the Township is involved, subject to the approval of the Council.
(3) 
Upon the termination of his service with the Township, forthwith surrender to his successor all Township property, papers and records, together with a written consent to substitution of his successor in any pending actions or proceedings.
C. 
Special counsel. Whenever he deems the interests of the Township so to require, the Township Attorney may, with the approval of the Mayor and within the limits of the available appropriations, appoint special counsel to assist him in the preparation, trial or argument of any issue or in such other capacity as he may determine. If the Township Attorney should be disqualified with respect to any matter, the Mayor may appoint special counsel, with the approval of the Council, to represent the Township for and with respect to such matter.
D. 
The Township Attorney shall receive as compensation for his services those sums set forth within a fee schedule filed with and approved by the Township Council and as provided in the annual Salary Ordinance.[1]

A. 
Position created. Pursuant to N.J.S.A. 40A:9-136, the position of Township Administrator is hereby created.
B. 
Appointment, term of office, salary. The Township Administrator shall be appointed by the Mayor, with the advice and consent of the Township Council, in accordance with N.J.S.A. 40A:9-137. The term of office of the Township Administrator shall be at the pleasure of the governing body. The Township Administrator shall receive such salary as shall be prescribed by the Township Salary Ordinance.[1]

C. 
Removal from office. The Township Administrator may be removed by a 2/3 vote of the governing body. The resolution of removal shall become effective three months after its adoption by the governing body. In accordance with N.J.S.A. 40A:9-138, the governing body may provide that the resolution of removal shall have immediate effect; provided, however, that the governing body shall cause to be paid to the Administrator forthwith any unpaid balance of his salary and his salary for the next three calendar months following adoption of the resolution.
D. 
Qualifications. The Township Administrator shall be chosen on the basis of his executive and administrative abilities and qualifications, with special regard to education, training and experience in governmental affairs.
E. 
Vacancy. Any vacancy in the position of Township Administrator shall be filled by appointment by the Mayor, with the advice and consent of the Township Council.
F. 
Duties and responsibilities. The Township Administrator shall, under the supervision and control of the Mayor, and to the extent not prohibited by law, have the following duties and responsibilities:
(1) 
To serve as the principal administrative officer representing the Mayor and Township Council.
(2) 
To supervise the administration of all departments and offices, in consultation with the respective department heads and as directed by the Mayor.
(3) 
To represent the Township in its relation to the federal, state and county governments and to other municipalities and to evaluate the Township's interest in contracts, franchises and other business transactions as assigned by the Mayor.
(4) 
To keep the Mayor and Township Council informed of the financial condition of the Township and to make such reports thereon as required and to prepare, annually, a comprehensive report on the financial condition of the Township.
(5) 
To study the administrative and other operations of the Township and make recommendations for plans and programs to meet the changing needs of the Township.
(6) 
To receive and reply to inquiries and complaints concerning Township business and to provide information and assistance in respect thereto.
(7) 
To attend all meetings of the Township Council as required.
(8) 
To establish and maintain sound personnel practices and maintain appropriate records of all employees and to have the authority to recommend to the Mayor and Township Council the initial hiring and disciplining of all Township employees.
(9) 
To recommend the nature, location and extent of public improvements and to coordinate the execution of the same when authorized by the Mayor and Township Council.
(10) 
To implement and enforce the policies of the Mayor and Township Council with respect to the compiling and release of public information.
(11) 
To receive from each department, office and board their annual budget requests and to review and transmit the same, along with his comments and recommendations, to the Mayor and Township Council.
(12) 
To consult with the Mayor and Township Council on the preparation of the tentative budget, recording changes, additions and deletions thereto and to submit final recommendations in the form required by law, together with an analysis of the various items of expenditure and revenue and such explanatory comments as may be required.
(13) 
To maintain a continuing review and analysis of budget operations, work progress and the costs of municipal services.
(14) 
To supervise the disbursement of all Township funds and to approve all vouchers and bills before submitting the same to the Township Council for final approval, as directed by the Township Council.
(15) 
To supervise and continually review the Township's insurance program.
(16) 
To act as purchasing agent on behalf of the Township in accordance with N.J.S.A. 40A:11-9, and within guidelines established by resolution of the Council, as necessary, to prepare public advertising for bids and to receive bids for the purchase of work, materials and supplies on behalf of the Township, to assist the Township Council in negotiating contracts for the Township and to make awards of contracts in the name of the Township, as authorized by and subject to the approval of the Township Council.
(17) 
To act as a liaison on behalf of the Township with all utility companies serving any portion of the Township to be sure that such utilities are providing adequately for the needs of the residents of the Township.
(18) 
To assure that the provisions of all franchises, leases, permits and privileges granted by the Township are complied with.
(19) 
To require each department to maintain adequate inventory records of all equipment and materials owned and used by the Township and to arrange for the disposal of all inadequate or obsolete materials when directed to do so by the Mayor and Township Council.
(20) 
To assist the residents of the Township in matters within his jurisdiction, to maintain a record of complaints submitted to him for his attention and to take proper steps to remedy the causes for such complaints.
(21) 
To keep the Township Council currently informed of all matters within the Administrator's jurisdiction by such reports, verbally or in writing, as he deems advisable or as may be requested by the Mayor and Township Council and to submit an annual written report of his work accomplished and to assist the Mayor in preparation of his annual report on the condition of the Township for the benefit of the public.
(22) 
To perform such other duties as may be assigned to him from time to time by the Mayor and/or Township Council.
G. 
Position to be full time. The Township Administrator shall devote full time to the interests of the Township. The Township Council reserves the right at any time to set specific hours for the Administrator by resolution.
H. 
Construal of provisions. Nothing in this section shall derogate from or authorize the Township Administrator to exercise the powers and duties of the elected and appointed officials of the Township.
