This article shall permit the Township of Logan to accept voluntary contributions from persons for the improvement of public safety and/or recreation programs within the township.
As used in this article, the following terms shall have the meanings indicated:
PERSON
Includes any individual, corporation, company, association, society, firm, partnership or organization.
PUBLIC SAFETY
Those programs concerning the operation of the township's Police Department and fire companies and rescue/ambulance squads formally recognized by the Township of Logan.
RECREATION
Those programs administered by the Township Council with advice from the Logan Township Youth, Parks, Recreation and Library Committee.
A. 
All contributions made pursuant to this article shall be deposited in a municipal account known as "Reserve for Contributions Towards Costs of Improvements for Public Safety and Recreation."
B. 
Expenditures shall not be made from the account unless the acquisition for which the expenditures are to be committed is of a purpose which qualifies the acquisition under the Local Bond Law, N.J.S.A. 40A:2-1 et seq.
The final determination as to the expenditure of funds for the capital purposes aforesaid shall he made by the Township Council. The decision shall be by majority vote of a quorum of the Township Council, except when the voting requirement may be otherwise in the event that the provisions of N.J.S.A. 40A:2-17 are applicable.
Nothing contained in this article shall be construed as requiring or mandating a person to make any public safety or recreation contribution to the Township of Logan, except in those circumstances where the township has changed its position in reliance upon the promise to make a contribution for any of the purposes authorized herein. The foregoing to the contrary notwithstanding, the township may take any action provided by law to enforce a promise to make a gift upon which it has detrimentally relied.
