A. 
The Shade Tree Committee of the Township of Logan is hereby established.
B. 
The Committee shall consist of seven members appointed by the Mayor, with the advice and consent of Council. Members shall be residents of the Township of Logan or owners of real property located therein. Said members shall serve without compensation, except as herein provided.
C. 
A secretary to the Committee, who may or may not be a member, shall be appointed by the Mayor. The salary of the secretary, who may be compensated even if a member, shall be fixed by the governing body.
A. 
The initial terms shall be as follows: one-year term, one member; two-year term, one member; three-year term, one member; four-year term, two members; five-year term, two members. At the expiration of these respective terms, all subsequent appointments shall be for a term of five years.
B. 
The terms of office for members shall commence on the day of their appointment, which, except for initial appointments, shall be January 1.
Any vacancy occurring by reason of death, resignation or removal of any member shall be filled for the unexpired term of the original appointee.
The scope, responsibilities and powers of the Shade Tree Committee shall be as follows:
A. 
Exercise full and exclusive control over the regulation, planting and care of shade and ornamental trees and shrubbery now located, or which hereafter may be planted, in any public highway, park, parkway or other public grounds, except in areas under state or county jurisdiction as defined in N.J.S.A. 40:64-1 (cited for definitional purposes only).
B. 
Regulate and control the use of the ground surrounding the same, so far as may be necessary for their proper growth, care and protection.
C. 
Move or require the removal of any tree, or part thereof, dangerous to public safety.
D. 
Care for and control such parks and parkways.
E. 
Encourage arboriculture.
F. 
Make recommendations to the Planning and/or Zoning Boards as more particularly set out in this chapter.
A. 
When an application for subdivision or site plan approval is submitted to the Planning or Zoning Board, said Board, within one week of submission, shall advise the Shade Tree Committee of the application, whereupon the Committee shall inspect the property involved, noting the number, type and location of the various trees situate on the land proposed for development and their approximate age and density of growth, together with the topography and proposed plan of development.
B. 
At the next regular meeting of the referring Board, the Shade Tree Committee shall make a written report of its findings to the Board, together with any recommendations it may have regarding the safeguarding of desirable trees during the course of development.
The cost of the removal of any tree or part thereof dangerous to public safety, as determined by the Shade Tree Committee, shall be a charge upon the real estate where the tree is situated, if the owner thereof is given written notice to remove such tree, and fails to do so within 10 days of receipt of said notice. Said charge shall be due and payable to the Township Clerk.
The township governing body shall annually appropriate such moneys as it may deem necessary for the purchase of trees and shrubbery and the purchase of necessary equipment, services and materials.
