A. 
It is hereby declared that the City of North Wildwood, in the County of Cape May, is a seashore resort municipality containing an amusement and entertainment area according to the customary understanding of such terms in said city, which area is more particularly described as follows:
(1) 
All those lands and premises 100 feet west of the Boardwalk, eastward to and including all those areas on the Boardwalk and east thereof available for amusement games, extending between the south side of 16th Avenue to the north side of 26th Avenue.
B. 
It is hereby declared that the City of North Wildwood, in the County of Cape May, contains another amusement and entertainment area according to the customary understanding of such terms in said city, which area is more particularly described as follows:
(1) 
All those lands and premises fronting on New Jersey Avenue, to a depth of 100 feet east and west, beginning at the north corner of 10th Avenue and extending northeastwardly along New Jersey Avenue and Olde New Jersey Avenue to the Hereford Inlet.

A. 
It shall be unlawful for any person, firm or corporation to hold, operate or conduct or to allow, permit or suffer the holding, operation or conduct of any amusement game in the City of North Wildwood, in the County of Cape May, unless and until a license therefor has been issued by the Council of the City of North Wildwood in accordance with the regulations promulgated by the State Commissioner of Amusement Games Control of the State of New Jersey and pursuant to the authority of this chapter.
B. 
On and after the adoption of this chapter, the annual license fees or charges for the holding, operating or conducting of any of the several classes of permissible amusement games, as fully described and provided for in Regulation No. 7 of the Amusement Games Regulations, shall be as follows:

(1) 
Objects thrown or propelled at target games: one game per license; Permissible Amusement Games Certificate No. 1: $500.
(2) 
All arcade machines or device games (Pokerino, Pinball, Slots, Poker, Skee Ball, etc.) except soda machines.

(a) 
Permissible amusement games under Certificate No. 2: $1,000, plus $5 for each additional redemption game in excess of 50.
(b) 
For amusement arcades where coin-operated amusement machines are operated, payment for the New Jersey Certificate No. 2 Arcade License(s) shall constitute payment for the mercantile license for the arcade only.
(3) 
Nondraw raffle games permitting blind selection of prize: one game per license; Permissible Amusement Games Certificate No. 3: $500.
(4) 
Competitive achievement games (Skillo, Fascination, Bowlo, etc.): one game per license; not more than 100 players per license or fraction thereof; Permissible Amusement Games Certificate No. 4: $1,250.
(5) 
Games of chance incorporating laydown boards, electric push buttons, start and stop, moving indicators and symbols and numbers known as "stop and go games": one game per license; Permissible Amusement Games Certificate No. 5: $1,000.
(6) 
Guessing games known as "guess your weight" or "guess your age": Permissible Amusement Games Certificate No. 6: $500.
(7) 
Ring the bell game or high striker game: Permissible Amusement Games Certificate No. 7: $500.
(8) 
Log roll, rope climb, fishing game, skin the wire game, bottle stand-up, etc.: Permissible Amusement Games Certificate No. 8: $500.
(9) 
A game of chance incorporating a laydown board marked in segments bearing numbers, names or symbols, whereon the player or players place the entry fee as an indication of the choice of expected winner, which is determined by a nonelectrical and nonmechanical device, set in motion by a player or players, coming to rest, generally known as "pan game," "crazy ball" and "crazy block": Permissible Amusement Games Certificate No. 9: $500.

A. 
No licensee shall hold, operate, conduct or allow, permit or suffer the holding, operation or conduct of any amusement game on the licensed premises between the hours of 3:00 a.m. and 8:00 a.m., Mondays through Fridays, inclusive, and between the hours of 4:00 a.m. and 8:00 a.m. on Saturdays, Sundays and holidays.
B. 
The regulations promulgated by the State Commissioner of Amusement Games Control, insofar as they relate to the holding, operation and conduct of amusement games in the City of North Wildwood, are hereby made a part of this chapter.
C. 
Separate licenses shall be required for each specific kind of amusement games as set forth in § 5-2B.
D. 
No licensee shall operate any loudspeaker within or without the premises which can be heard outside the premises after the hour of 11:00 p.m.
E. 
The following are the only licenses permitted in the New Jersey Avenue entertainment area:

(1) 
Permissible Amusement Games Certificate No. 1.
(2) 
Permissible Amusement Games Certificate No. 2.
(3) 
Permissible Amusement Games Certificate No. 3.
F. 
Licenses issued to establishments in the New Jersey Avenue amusement and entertainment area will be issued for a maximum of 10 games per establishment.

G. 
No license shall be issued in the New Jersey Avenue amusement and entertainment area to an establishment within 500 feet of another licensed establishment.

Under no circumstances shall a license or rights thereunder be deemed property, subject to sale or any transfer whatsoever, and the attempt to sell or transfer shall be grounds for suspension or revocation of said license.

Any person violating any provision of this chapter shall, upon conviction, be punishable by a fine not to exceed $1,250 or imprisonment for a term not to exceed 90 days, or both, and the same shall be in addition to the powers of suspension or revocation of any such license by the governing body.
