As used in this ordinance, "electric personal assistive mobility device" shall mean "electric personal assistive mobility device" as defined in N.J.S.A. 39:4-14.10.
Between the hours of sunrise and sunset, as those hours are established by the U.S. Naval Observatory, Astronomical Applications Department (aa.usno.navy.mil) for the City of North Wildwood, it shall be lawful for an individual to operate an electric personal assistive mobility device on the streets, bike paths and boardwalk that are located within the confines of the City of North Wildwood except that, between May 1 and October 1 it shall be unlawful for an individual to operate an electric personal assistive mobility device on the boardwalk and, at all times, it shall be unlawful for an individual to operate an electric personal assistive mobility device on the county highways and state highways that are located within the confines of the City of North Wildwood. In addition to the helmet provisions that are set forth in N.J.S.A 39:4-14.10, an operator of an electric personal assistive mobility device shall wear a reflective vest. Nothing in this section shall be deemed as prohibiting a law enforcement officer from operating an electric personal assistive mobility device within the City of North Wildwood during the regular course of that officer's law enforcement duties.
It shall be unlawful to operate an electric personal assistive mobility device in designated areas at a speed in excess of eight miles per hour.
It shall be unlawful for any person or business entity to rent an electric personal assistive mobility device to any individual for operation within the City of North Wildwood; however, nothing in this chapter shall be deemed or interpreted as prohibiting an individual or business from operating a tour business wherein electric personal assistive mobility devices are utilized in conjunction with guided tours of the City of North Wildwood so long as the guided tour is confined to those areas within the City of North Wildwood which have been designated by resolution for operation of electric personal assistive mobility devices as set forth above. Excluding the tour guide, guided tours wherein electric personal assistive mobility devices are being operated in designated areas of the City of North Wildwood shall not contain more than six individuals. Prior to May 15 every year City Council, by way of resolution approved by the Mayor, shall designate those highways, streets and bicycle paths, or portions thereof, where it shall be lawful to operate an electric personal assistive mobility device between the dates of May 15 and November 1, and that resolution also shall designate the hours when operation of an electric personal assistive mobility device is permissible.
Any person who shall violate any of the provisions of this chapter, upon conviction thereof, shall be subject to a fine of up to $1,250 and/or 90 days in the county jail for each offense or violation.
