The City Council of the City of Lancaster finds and declares that the
provisions of this chapter are enacted to establish regulations regarding
the operation of skateboards on the roadways, sidewalks, public parks, paths,
public places or public property of the City of Lancaster.
Unless otherwise indicated, all provisions of this chapter shall apply
to all skateboards operated within the jurisdictional boundaries of the City
of Lancaster.
As used in this chapter, the following terms shall have the following
meanings:
That portion of the highway designed or ordinarily used for vehicular
travel, excluding sidewalks.
That portion of the highway designated or ordinarily used for pedestrian
travel.
A single platform mounted on wheels, which is propelled solely by
human power and which has no mechanisms or other device with which to steer
or to control the movement or direction of the platform.
Every device, excluding skateboards, wagons, wheelchairs, unicycles,
pushcarts, tricycles and other children's toys, in, upon or by which any person
or property is or may be transported or drawn upon a roadway or sidewalk.
A.
No person shall ride a skateboard upon any sidewalk,
park, school yard or any public place or any roadway so as to obstruct pedestrian
traffic or endanger another person's safety, or ride a skateboard on any highway,
street or roadway in such a manner so as to impede the normal flow of vehicular
traffic.
B.
No person shall let a skateboard stand upon any sidewalk,
park, path, roadway or any public place where it is an obstruction or hazard
to pedestrians.
C.
No person shall ride a skateboard onto or from any bench,
chair, flower box, retaining wall, stairway or other public accessory or structure
not intended for pedestrian foot traffic, or intended only for pedestrian
foot traffic.
D.
No person or pedestrian shall ride or operate a skateboard
on a sidewalk within one block of the area of the City of Lancaster know as
"Penn Square." The Lancaster City Traffic Commission of the City of Lancaster
is authorized to erect official traffic control devices on those roadways
where skateboarding shall be designated as prohibited.
E.
No person shall operate or ride a skateboard on any roadway
where the volume or speed of the vehicular traffic or the width of the roadway
renders the roadway unsafe or unsuitable for skateboarding.
F.
Skateboard operators on sidewalks and roadways shall
yield the right-of-way to all vehicular and to all other pedestrian (non-skateboard)
traffic upon the sidewalk or roadway.
G.
No more than one person shall operate or ride on a single
skateboard at one time.
The Chief of Police or his designee is authorized to establish all written
regulations necessary to implement the provisions of this chapter.
No person shall operate a skateboard on any roadway or public alley
in the City of Lancaster in violation of any traffic ordinance of the City
of Lancaster or the law of the Commonwealth of Pennsylvania.
Every person convicted of violation of any provision of this chapter
shall be punished by a fine of not more than $50 and shall be ordered to pay
restitution should any damage or injury have resulted from the act giving
rise to the violation of this chapter.
