Compensation shall be paid to those regular full-time employees of the Borough of Shippensburg, except policemen, as hereinafter defined, and in the amounts hereinafter specified, which employees are not eligible for membership and benefits under the Borough of Shippensburg Employee Pension Plan and which employees were in the employment of the Borough of Shippensburg at the time of adoption of the Borough of Shippensburg Employee Pension Plan.
As used in this article, the following terms shall have the meanings indicated:
EMPLOYEE
Those regular full-time employees of the Borough of Shippensburg who meet the following requirements:
A. 
The employee is not eligible for membership and benefits under the Borough of Shippensburg Employee Pension Plan and the employee was in the employment of the Borough of Shippensburg at the time of adoption of the Borough of Shippensburg Employee Pension Plan
B. 
The employee, immediately prior to retirement, has been regularly employed by the Borough of Shippensburg for a period of not less than 10 years.
C. 
The employee, at date of retirement, shall be not less than 60 years of age.

Said yearly compensation to be paid to said employee as defined in § 37-2 aforesaid shall be an amount equal to 1% of the final average earnings of said employee for each year of service, with a maximum of 25 years, provided further that "final average earnings" shall be defined as the average annual earnings for the three years immediately preceding the retirement of the employee, provided further that the compensation to be paid aforesaid shall in no event exceed the total sum of 1/2 of the compensation last paid to the said employee, plus benefits received by the said employee under the United States Social Security Act, if any. Effective January 1, 1992, said yearly compensation to be paid to said employee as defined in § 37-2 aforesaid shall be an amount equal to one and 1/4% of the final average earnings of said employee for each year of service, with a maximum of 25 years. Effective January 1, 1993, said yearly compensation shall be an amount equal to 1 1/2% of the final average earnings of said employee for each year of service, with a maximum of 25 years.

There is hereby created a Board to be known as the "Nonuniform Employees Pension Board of the Borough of Shippensburg." The Board shall have six members, which shall be the Borough Manager, Borough Treasurer, one member of Council, one member of the Nonuniformed Collective Bargaining Unit, one retiree and the Borough Assistant Secretary. The members shall serve for five-year terms, except the member of Council, who shall serve until the next reorganizational meeting of Council, at which time Council shall appoint or reappoint a member of Council to the Board. The Board shall have the responsibility and power to recommend pension modifications to the Council.
