It shall be unlawful for any person or persons, firm, association or corporation to cast upon, throw, deposit or discard into or cause to be cast upon, thrown, deposited or discarded into any stream, spring or creek or along or upon the shores, banks or margin of the same within the Borough of Shippensburg, Cumberland and Franklin Counties, Pennsylvania, any rubbish, trash, garbage or refuse, including but not limited to glass and metal refuse, household waste or any other discarded items or waste at any time.
No person, firm or corporation shall cause the flow of any such stream of water to be impeded by the construction of any dam or any other obstruction; provided, however, that this section shall not prohibit stream improvement projects by local sportsmen clubs or conservation agencies when the same are approved by appropriate agencies of the Commonwealth of Pennsylvania and/or the Borough Manager of the Borough of Shippensburg.

Any person, partnership or corporation violating any provisions of this article shall, upon conviction in summary proceedings, be sentenced to pay a fine of not less than $300 nor more than $1,000 per offense and, in default of the payment of such fine, may be imprisoned for a period of not more than 90 days. Each day of violation shall be considered a separate and distinct offense.
