The tract of land located in the Borough of Shippensburg, Franklin County, Pennsylvania, and bounded on the south by a public street known as Park Place, on the west by a public street known as Park Place West, on the east by the Western Maryland Railroad right-of-way and on the north by land of the West End Land Company of Shippensburg, is hereby established as a public park of the Borough of Shippensburg, to be designated "Memorial Park."

The two tracts of land located in the Borough of Shippensburg, Cumberland County, Pennsylvania, and bounded as follows, are hereby established as a public park of the Borough of Shippensburg, to be designated "Dykeman Springs Wetland Park":
A. 
Tract No. 1: Bounded on the east by lands now or formerly of Dykeman Road; on the south by lands now or formerly of Shippensburg Gas Company and Terry Beecher; on the north by lands of Consolidated Rail Corporation; on the north by lands of Charles Myers and Donald Reed; containing 5.08 acres more or less. The area included within said description is in accordance with a draft prepared by Arrowood, Inc., dated April 6, 1982, Drawing No. 82-13 and entitled "Draft of Survey of Tract of Land in the Borough of Shippensburg, Franklin County and Cumberland County, Pennsylvania."
B. 
Tract No. 2: The tract of land located on the south side of Dykeman Road in the Borough of Shippensburg, Cumberland County, Pennsylvania, bounded on the east by lands now or formerly of Lawrence Little; on the south by other lands of the Shippensburg Sanitary Authority; on the west by other lands of the Shippensburg Sanitary Authority and on the north by Dykeman Road, having frontage on Dykeman Road of 500 feet and extending in even depth in an easterly direction a distance of 360 feet.

The following rules and regulations are hereby established for the management and protection of Memorial Park, Dykeman Springs Wetland Park and such other public park or parks as the Borough Council may designate from time to time by resolution or ordinance, hereinafter collectively and individually designated "the park":
A. 
Hours. The Memorial Park and Dykeman Springs Wetland Park shall be open daily to the public between sunrise and sunset as determined by the official meteorological schedule for the rising and setting of the sun. This shall not apply to those areas of the park which shall be open after the above times for events sanctioned by the Park and Recreation Commission, such as picnics, baseball/softball games, football, soccer, field hockey or other athletic events. The parking areas and basketball courts located at the Shippensburg Community Center shall be open between the hours of 6:00 a.m. and 10:00 p.m. prevailing times, except when otherwise authorized by the Commissioners of the Shippensburg Areawide Park and Recreation Commission.

B. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, ball fields, tables and benches, buildings, structures or fixtures therein or any other property of the Borough of Shippensburg located within the park.
C. 
No person shall remove any bench, seat or table from the park or change the location thereof without permission from the Borough of Shippensburg or Shippensburg Park Commission.
D. 
No person shall conduct himself within the park so as to annoy any other person using the park for recreational purposes.
E. 
No person shall set up any booth, table or stand for the sale of any article whatsoever within the limits of the park without the consent of the Borough of Shippensburg or Shippensburg Park Commission, which shall have authority to refuse such consent in any instance.
F. 
No person shall dispose of any waste or garbage in the park except in receptacles designated for the respective purposes. All persons using the park shall dispose of all waste and garbage left by them in such proper receptacles.
G. 
No person shall set or maintain any fire in the park except in proper grills outside the pavilions or in stoves and fireplaces maintained for the purpose and located by authority of the Borough of Shippensburg or Shippensburg Park Commission.

H. 
No person shall bring into the park, or otherwise have in their possession in the park, any illegal drugs or other illegal substances, either for his or her own use or for the use of any other person.

I. 
No person shall operate any motor vehicle or any other vehicle, including but not limited to a minibike, motorcycle, snowmobile or bicycle, or ride a horse, except upon hard-surface roads designated for vehicular traffic within the park.

J. 
Parking of any motor vehicle or any other vehicle, including but not limited to a minibike, motorcycle, snowmobile or bicycle, and securing of horses, shall be only within the designated public parking areas within the park.

K. 
No person shall fish in any pond or body of water contained within any Borough park property. Fishing for special events may be authorized by a resolution of Borough Council from time to time.

L. 
It shall be unlawful for any person to possess or consume any alcoholic beverages in the park, except when permitted in conjunction with an event authorized by the Shippensburg Community Parks and Recreation Authority.

A. 
Any person violating any of the provisions of § 110-2, other than § 110-2J, shall, upon conviction thereof, be punishable by a fine of not more than $300 and costs of prosecution or, upon default in payment of the fine and costs, by imprisonment in the county jail for not more than 30 days.

B. 
Any person who shall violate the provisions of § 110-2J herein shall, upon conviction thereof, be sentenced to pay a fine of up to $15 and costs of prosecution for each and every offense, and in default of payment of the fine and costs, to undergo imprisonment for not more than five days in the county jail.
