Wherever a space shall be marked off on any
highway for the parking of an individual vehicle, every vehicle there
parked shall be parked within the lines bounding such space.
A.Â
Parking of motor vehicles or other vehicles shall
be prohibited in or along all of the streets and roadways and on any
other area within the confines of the public park area known as "Memorial
Park" within the Borough of Shippensburg, except those areas within
said Memorial Park designated as public parking areas for motor vehicles
or other vehicles; and provided, however, that only those motor vehicles
bearing registration plates issued to a handicapped person shall be
permitted to be parked in those designated spaces marked, reserved
for a handicapped person, at the stadium area within Memorial Park
and within the pavilion area of Memorial Park, and no other parking
of any motor vehicle or other vehicle shall be allowed in said designated
spaces.
B.Â
Parking of motor vehicles or other vehicles within
the confines of the public premises of the Borough of Shippensburg
known as "Shippensburg Community Center," adjoining North Fayette
Street and Springhouse Road within the Borough of Shippensburg, is
hereby prohibited in the following area; provided, however, that only
those motor vehicles bearing registration plates issued to a handicapped
person shall be permitted to be parked along the westerly edge of
the Community Center building in those spaces marked, reserved for
a handicapped person, and no parking of any other motor vehicle or
other vehicle shall be allowed in said designated spaces:
Beginning at a point at the southwest corner
of the outside wall of the Community Center building; thence along
the outside wall of the Community Center building in a northerly direction
and by a line parallel to the said outside wall to a point at the
south side of Springhouse Road; thence along the south side of Springhouse
Road in an easterly direction to a point at the westerly edge of Middle
Spring Creek; thence along the westerly edge of Middle Spring Creek
in a southerly direction to a point at the property line of property
of the Borough of Shippensburg known as "Shippensburg Community Center";
thence in a westerly direction along the property line of property
of the Borough of Shippensburg to a point at the westerly edge of
North Fayette Street; thence along the westerly edge of North Fayette
Street in a northerly direction to a point at the edge of the said
North Fayette Street, which point is 113 feet from the southwest corner
of the outside wall of the Community Center building and parallel
to the southerly edge of the said outside wall of the said Community
Center building; thence in an easterly direction a distance of 113
feet to a point at the southwest corner of the outside wall of the
Community Center building.

A.Â
Parking shall be prohibited at all times on any bridge
within the Borough of Shippensburg. For the purposes of this section,
"bridge" shall mean any structure capable of carrying vehicular traffic
over a river, stream, canal, mill race or public utility facilities.

A.Â
At the request of a person with a disability or severely
disabled veteran, the Borough Council of the Borough of Shippensburg
may, from time to time, and by resolution, designate special parking
areas on the highways of the Borough as being reserved as a parking
space for persons with disabilities, and the Borough Council may restrict
the use of such space to a specific vehicle, license plate, or other
method of designation. The Borough Council may establish a fee for
requests for such designation, which fee shall be established by resolution
from time to time.

B.Â
Except for persons parking vehicles lawfully bearing
registration plates or parking placards issued to handicapped persons
or disabled veterans, no person shall park a vehicle on public or
private property which has been so posted in accordance with regulations
of the Department of Transportation of the Commonwealth of Pennsylvania.
C.Â
The following are hereby established as special purpose
parking zones, and it shall be unlawful for any person to park any
vehicle or tractor or to allow the same to remain parked in any such
zone, except as specifically provided for such zone:

Fire lanes established. The Borough Council of the
Borough of Shippensburg, Cumberland and Franklin Counties, Pennsylvania,
may, by resolution duly adopted, designate and mark such fire lanes
in the Borough, on private property devoted to public use, as may
be reasonable and necessary. Such fire lanes shall be the area immediately
adjacent to said building, 12 feet in width, on property such as apartment
buildings or complexes, theaters, churches and similar properties,
as are deemed necessary by the Council to ensure proper ingress and
egress of fire and emergency vehicles for protection of property and
persons.

(1)Â
Parking or obstruction prohibited. Parking of unattended
motor vehicles, barricading or obstructing a fire lane, shall be prohibited
at all times, and said fire lanes shall be posted with a sign displaying
NO PARKING - FIRE LANE. For the purposes of this section, parcel pickup
and/or delivery shall not be prohibited, and attended motor vehicles
where a licensed driver is present at all times to allow immediate
removal shall be permitted.
(2)Â
Marking and maintenance. The marking and maintenance
of fire lanes designated by the Borough Council shall be at the cost
and expense of the property owner or occupant.
(3)Â
Removal of vehicles.
(a)Â
Any vehicle parked in violation of the provisions
of this subsection may be towed away, and vehicles then towed away
may be released only after paying the towing fee and/or storage charges.
Payment of towing and storage fees shall not relieve the owner or
operator from any fines or penalties for violation of this subsection.
The Police Department shall, within 12 hours of removal, provide notice
to the owner of record of the vehicle so removed that such has occurred
and:
(b)Â
Registration of an illegally parked vehicle
in the name of a person shall be prima facie evidence that such person
was in control of the vehicle at the time of the violation.
(4)Â
The Borough Fire Chief will author a list of authorized
fire lane establishment order writers and present this list to Borough
Council annually.

Existing fire lanes will be reviewed annually for
compliance. Upon any new construction, i.e., businesses, churches,
industries, schools, etc., or at the request of a property owner,
the Fire Chief or designee will review such properties to determine
need.

Application procedure.

(a)Â
Upon identifying the need for a fire lane, the
Fire Chief or authorized order writer must complete the fire lane
establishment order and present a copy to the property representative
along with a copy of the fire lane diagram. A copy of each shall also
be provided to the Borough Fire Chief.
(b)Â
Upon receipt of the fire lane establishment
order and diagram, the Borough Fire Chief will review the order and
hold it until the order completion date of 30 days from the date of
the issuance of the order, at which time the Borough Fire Chief or
the order writer will return to the property to verify compliance.
(c)Â
After compliance is verified, the Borough Fire
Chief will sign and date the order form and present the order to Borough
Council for adoption by resolution at its next scheduled meeting.
(d)Â
Once the order is adopted, the Borough Fire
Chief will stamp the fire lane establishment order "approved, and
copies will be distributed to the Police Department and each of the
Fire Departments.
(e)Â
The original fire lane establishment order will
be kept on file at the Borough Office.
(7)Â
Noncompliance.

(a)Â
Should the property representative fail to establish
the approved fire lane within the thirty-day period, the Borough Fire
Chief shall at his/her discretion grant up to a seven-day extension
and note such action on the fire lane establishment order.
(b)Â
Should the property representative fail to establish
the fire lane within the extension period, the Borough Fire Chief
shall notify Borough Council of the noncompliance status of the property.
(c)Â
Council will address the issue, at its next
scheduled meeting, as to what action should be taken.
(8)Â
Dispute.

(a)Â
A property representative may appeal a fire
lane establishment order to the Borough Fire Chief within five business
days of receipt of the order.
(b)Â
The Borough Fire Chief shall respond, to the
property representative, in writing, as to his/her decision to the
appeal within five business days.
(c)Â
The property representative may appeal the decision
of the Borough Fire Chief to the Shippensburg Borough Council within
five business day of receipt of the decision of the Borough Fire Chief.
(d)Â
Council shall take the issue under advisement
at its next scheduled meeting and render a decision within 30 days.
The decision of Council shall be final.
(9)Â
FIRE LANE ESTABLISHMENT ORDER
ORDER WRITER
Definitions. As used in this section, the following
terms shall have the meanings indicated:

A paper form, established by the Borough Fire Chief, which
must be completed by the order writer when requests are made to or
by a property owner or representative to establish fire lanes.
Any person who the Borough Fire Chief has authorized to complete
a fire lane establishment order.

Fire hydrants. It shall be unlawful to stand or park
a vehicle within 15 feet of a fire hydrant.

F.Â
It shall be lawful for contractor vehicles to park
in a parking meter zone by placing a Borough-issued bag on the meter
of said zone. A bag featuring a permit number and dates valid for
use will be issued upon the remittance of a fee and receipt and verification
of a valid permit application by the Borough Secretary. Once issued,
the permit and bag will remain valid for the number of days specified,
not to exceed five consecutive calendar days. The fee for the permit
shall be set from time to time by resolution of the Council. For purposes
of this section, a "contractor vehicle" shall be defined as the vehicle
of a person registered as a home improvement contractor or a person
otherwise engaged in residential or commercial construction, repair
or alteration activities.

In addition to the above-designated streets, days
and times, the Borough Council may, by resolution duly adopted and
approved, add additional streets or alter the schedule for street
sweeping to conform to the needs of the Borough.

Towing. The Borough Manager or his designee may cause
vehicles to be towed away which are parked on the streets to be cleaned.
Any car thus towed away may be reclaimed after paying the towing and
storage fees.

Penalty. Any person, firm or corporation violating any provision of this section shall be subject to a fine as set forth in Chapter 144, Article VII, § 144-57B(2)(b) of the Code of the Borough of Shippensburg.

A.Â
Legislative intent. Regulation of parking is the responsibility
and within the power of the Council of the Borough. With the growth
of rental property within the Borough, a shortage of parking space
has resulted in problems for the residents of the Borough. There exists
a need to control parking and to provide a mechanism for the residents
to be assured that parking will be available to them which is convenient
to their residences. This is critical since many of the residents
of the Borough are senior citizens and cannot walk long distances
to a parking space from their residence. The Council of the Borough
has determined that a permitted residential parking program will alleviate
the pressures upon the existing parking space available and will assure
to the residents of the Borough the availability of parking spaces
where needed.

Definitions. As used in this section, the following
terms shall have the following meanings indicated:
The Manager appointed by the Council and/or his designee.
A stall that is designated by a numeric number.

A stall that is designated by the word "visitor."

A single unit providing complete living facilities for one
or more persons, including provisions for living, cooking and eating,
and equipped with sanitary facilities; provided, however, that each
room in a rooming house shall be considered a dwelling.
The Chief of Police and the appointed police officers of
the Borough of Shippensburg.
New Year's Day, Presidents' Day, Memorial Day, Independence
Day, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day.
A vehicle which is self-propelled, except a vehicle powered
solely by human power.
A natural person, firm, partnership, association or corporation.
Restricted to the practices of dentistry, medicine, law and
accounting.
A way intended for the use by the general public to provide
a means of travel for vehicles and pedestrians. The word shall include
the words "road," "highway" and thoroughfare."
Every device in, upon or by which any person or property
is or may be transported or drawn upon a highway, except devices used
exclusively upon rails or tracks.
C.Â
Residential parking program procedures. The residential
parking program (RPP) of the Borough shall be as follows:
(1)Â
Sticker required; numbering and assigning of
designated spaces.
(a)Â
During the times set forth in Subsection C(2) of this section, no person shall be permitted to park a motor vehicle in or on or along the side of any street or of any municipal parking area of the Borough of Shippensburg, Cumberland and Franklin Counties, Pennsylvania, set forth in Subsection C(3) hereof and known as the "residential parking program area" (RPPA), unless there appears in a visible location on the rear bumper of said vehicle a parking sticker as provided in Subsection C(4) herein or unless there appears in a visible location on the front dashboard of said vehicle a valid guest card as provided by Subsection C(4)(b) and (c).
(b)Â
The Borough Council may, by resolution, duly
adopted, provide for the numbering and assigning of designated spaces
in the RPPA to dwelling units.
(2)Â
The residential parking program shall be in effect 24 hours per day, in the Residential Parking Program Area designated hereafter in Subsection C(3)(a).
(3)Â
The residential parking program area covered
by this section shall be:
(a)Â
Spring Street, from the intersection of the
Roxbury Road to its terminus at lands now or formerly of the Spring
Hill Cemetery.
(4)Â
The stickers or cards provided by this section
shall appear and cost as follows:
(a)Â
The sticker shall measure three inches by five
inches and shall cost $10 per year.
(b)Â
Guest cards shall be prepared by the Manager
of the Borough of Shippensburg and shall cost $2.50 each for the first
card, and any additional guest card permitted by this chapter shall
cost $5 per card. Lost or stolen cards shall be replaced at the cost
of the original card.

for stickers or cards provided by this section shall be as follows:
(a)Â
Stickers.

Any person living in a residence abutting the
streets in the RPPA shall be entitled to receive a residential parking
sticker, which shall be nontransferable, upon presentation of:

The sticker number and the stall number shall
correspond with the dwelling unit number of the resident applying
for the sticker. All vehicles with a sticker must park in the designated
parking stall and may not park in a designated visitor's stall.
(b)Â
Guest cards.
[1]Â
Each single-family home and apartment unit in the RPPA is eligible to be issued up to two guest cards. Each rooming house in the RPPA is eligible to be issued one guest card per room. An applicant for guest cards must present proof of residency as required in Subsection C(5)(a). The Borough shall have no responsibility for the issuance of guest cards to a particular resident of a dwelling unit.

Guest cards may only be used by residents and
visitors of Spring Street. The card must be placed in the front window
of the driver's side of the vehicle. Guests may only park in those
parking spaces designated as "visitor," on a first-come basis. However,
with the permission of the resident holding a parking sticker, a guest
may share or utilize his/her designated parking stall as stated in
C(5)(d).

Each professional use shall be entitled to be
issued up to five guest cards. An applicant for guest cards for a
professional use must present proof of the location of the professional
use in the RPPA in accordance with the list in the Borough Manager's
office as mentioned heretofore.
(c)Â
Special business cards. Each owner and employee of a business doing business in the RPPA who are not exempt under Subsection C(6) shall be entitled to receive one special business parking card.
(d)Â
In the Spring Street permit parking area, more
than one vehicle may park in a designated parking stall only if by
doing so neither vehicle extends beyond the bounds, by width and length,
of the stall designation. If a permit is not obtained for a designated
parking stall space, the stall may be used as a visitor's stall until
such time as a permit is obtained.
(e)Â
On an annual basis or when conditions change,
a list shall be developed of all permits issued for the current year
and provided to the Police Department. This list will include the
permit number, make of vehicle, license plate number and the name
of the individual for whom the permit was issued.
(6)Â
The only persons exempt from the provisions
of this section shall be:

When an enforcement officer has reason to believe
that a guest card is not being used in accordance with the purpose,
intention and provisions of this chapter, the Borough Manager shall
be notified. The Borough Manager shall then send a letter to the possessor
of the subject card informing that person that the card is being used
improperly. If the violation continues, the Borough Manager may revoke
the guest card so long as the possessor of said card is afforded an
opportunity at an informal hearing with the Borough Manager to explain
his or her position. If a guest card is revoked, the possessor of
said card shall deliver to the Borough Manager said card. Parking
in the RPPA with a revoked guest card shall be the same as parking
with no guest card or residential sticker. Violators shall be ineligible
for guest card issuance for a twelve-month period following the revocation
of the guest card.
(9)Â
If a person sells his or her motor vehicle,
he or she must remove the sticker and present it to the Borough Manager.
If a replacement vehicle is purchased, the old sticker may be exchanged
for a new one at a cost of $1.
D.Â
Violations and penalties.
(1)Â
An owner or operator of a motor vehicle parked
in violation of any provision of this section shall be issued a notice
of violation and be ordered to pay a fine of $5 payable to the Borough
of Shippensburg, within 10 days of issuance of such notice.
(2)Â
Failure to respond to the notice of violation
by payment of the fine as aforesaid, which payment must be made to
the Borough of Shippensburg within 10 days of issuance of such notice,
shall result in the issuance of a citation to the defendant. Thereafter,
the prosecution shall proceed in accordance with the Pennsylvania
Rules of Criminal Procedure, and, upon conviction for the offense,
the defendant shall be ordered to pay a fine of $5, together with
the costs of prosecution and/or be incarcerated in the county prison
for not more than five days.
(3)Â
It shall be the duty of the enforcement officers
of the Borough to report all violations of any provisions of this
chapter, indicating, in each case, the section thereof violated, the
license number of the vehicle involved in such violation, the location
where the violation took place, the time of such violation and other
facts necessary to secure a clear understanding of the circumstances
attending such violation. Each such officer shall also place upon
the vehicle a notice of violation to the owner or operator thereof
that such vehicle has been parked in violation of the provisions of
this chapter, instructing such owner or operator to pay the fine and
costs, as provided herein, and, further, notifying such owner or operator
that failure to respond will result in the issuance of a citation.
(4)Â
Vehicles parked in violation of this section
shall be subject to towing at the expense of the owner. The RPPA shall
