The provisions of this chapter shall be severable, and if any of its provisions shall be held to be unconstitutional, illegal or otherwise invalid, such decision shall not affect the validity of any of the remaining provisions of this chapter. It is hereby declared as a legislative intent that this chapter would have been adopted had such unconstitutional, illegal or otherwise invalid provision not been included herein.
A. 
All previous ordinances of the Borough of Shippensburg pertaining to the regulation of traffic and parking are hereby repealed.
B. 
The repeal of ordinances provided for in Subsection A above shall not affect or prevent the prosecution or punishment of any person for any act done or liability incurred in violation of any ordinance or regulation in force immediately prior to the taking effect of this chapter.
C. 
The provisions of this chapter, insofar as they are the same as those of ordinances and regulations in force immediately prior to the enactment of this chapter, are intended as a continuation of such ordinances and regulations and not as new enactments.

A. 
Traffic violations. Any person violating the provisions of Article II of this chapter shall be guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of not more than $25.
B. 
Parking violations.
(1) 
Special purpose parking zones. Any person violating the provisions of Article III, § 144-28 thereof, Special purpose parking zones (handicapped parking areas), shall be guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine and costs in accordance with and prescribed by § 3354(f) of the Motor Vehicle Code of the Commonwealth of Pennsylvania, 75 Pa.C.S.A. § 3354(f), as amended from time to time.

(2) 
Other parking violations.

(a) 
Metered parking areas. Any person violating the provisions of Article IV, § 144-36 thereof, Violations, shall be guilty of a summary offense and, upon conviction, shall be sentenced to pay a fine of $40 plus costs, including court costs and reasonable attorney fees incurred; provided, however, that any person accused of said violation may settle and compromise the claim against him or her for such illegal parking by paying to the Borough the sum of $5 within 48 hours from the time such illegal offense was committed, or $15 within 96 hours from the time such illegal offense was committed. If the fine is not paid within 96 hours from the time such illegal offense was committed, a notice of payment due will be sent to the owner of record, the fine will increase to $30, and payment must be made within two weeks of issuance of the notice.
(b) 
Except as provided in this § 144-57, Subsections A and B(1) and (2)(a) thereof, any person violating the provisions of Article III, IV or VI of this chapter shall be guilty of a summary offense and, upon conviction, shall be sentenced to pay a fine of not less than $25 nor more than $300 and costs of prosecution, including court costs and reasonable attorney fees incurred; provided, however, that any person accused of said violation may settle and compromise the claim against him or her for such parking violation by paying to the Borough the sum of $10 within 96 hours from the time such offense was committed. If the fine is not paid within 96 hours from the time such offense was committed, a notice of payment due will be sent to the owner of record, the line will increase to $20, and payment must be made within two weeks of issuance of the notice.
(c) 
Parking on highways or portions of highways named in Article V, § 144-43B. Any person violating the provisions of Article V shall be guilty of a summary offense and, upon conviction, shall be sentenced to pay a fine of $25 plus costs, including court costs and reasonable attorney fees incurred; and payment of towing and impoundment charges authorized by Article VI of this chapter.
C. 
Presumption of liability. The fact that a motor vehicle which is illegally parked is registered in the name of a person shall be considered prima facie proof that such person was in control of the motor vehicle at the time of such parking.
