As used in this chapter, the following terms shall have the meanings indicated:
ALARM SYSTEM
Any device designed for the detection of an unauthorized entry of a structure or enclosure, unlawful acts, fire or other emergency which, when activated, produces a signal, visual, audible or both, which signal is caused to be transmitted to the general area surrounding the premises so as to give notice to the general public or which signal is caused to be transmitted to the Town Police Department or Fire Department, or any alarm system which alerts any municipal organization by means of a signal which is transmitted to a receiver.
CALENDAR YEAR
January 1 to December 31.
FALSE ALARM
A. 
Any of the following:
(1) 
The unintentional activation of an alarm system by the owner or the lessee of an alarm system or an employee or agent of either.
(2) 
The activation of an alarm system by mechanical failure or malfunction caused by improper maintenance of the alarm system.
(3) 
The activation of an alarm system caused by improper installation or use of the equipment.
(4) 
The intentional activation of an alarm system where no unauthorized entry, commission of unlawful act or fire exists.
B. 
The above subsections do not include false alarms caused by abnormal weather conditions, acts of God or prior arrangements made for testing of the alarm system.
The installation and/or operation of an alarm system shall not give rise to any cause of action or claim or attach any liability to the Town for any reasons whatsoever, and the Town shall be under no duty or obligation to any person having an alarm system for whatever reason, including but not limited to any defect in an alarm system, any delays in response or delays in transmissions.
No person or business owning, using or possessing an alarm system or transmitting information regarding an alarm system, otherwise known as the "alarm system operator," shall cause or permit the giving of a false alarm, whether intentional, accidental or otherwise. Penalties for violation of this section shall be as follows:
A. 
For the first and second false alarms within a calendar year resulting in the dispatching of Town police or fire personnel the alarm system operator shall be given a written warning.
B. 
For the third and fourth false alarms within a calendar year resulting in the dispatching of Town police or fire personnel the alarm system operator shall pay a forfeiture of $100.
C. 
For the fifth and subsequent false alarms within a calendar year resulting in the dispatching of Town police or fire personnel the alarm system operator shall pay a forfeiture of $200.
D. 
Unauthorized entry false alarms.
(1) 
For the first and second false alarms within a calendar year resulting in the dispatching of Town police the alarm system operator shall be given a written warning.
(2) 
For the third and fourth false alarms within a calendar year the alarm system operator shall pay a forfeiture of $25.
(3) 
For the fifth and subsequent alarms within a calendar year the alarm system operator shall pay a forfeiture of $50.
E. 
The forfeiture for the violation will be issued to the alarm system operator, whether the owner, lessee, partnership, corporation or business entity.
