Town of Woodruff, WI Chapter 286 Fire Prevention

§ 286-1 Inspections.

A. The Fire Chief shall hold the office of Fire Inspector, with power to appoint one or more Deputy Fire Inspectors who shall perform the same duties and have the same powers as the Fire Inspector.

B. Whenever or wherever in the Town any inspection by the Fire Chief or his deputies reveals a fire hazard, the Chief or his deputies shall serve notice in writing upon the owner of the property, giving the owner a reasonable time in which to remove the hazard. If the fire hazard is not removed within the time allowed, it shall be deemed a nuisance. The Fire Chief or his deputy is authorized to have the same removed by the Town, and the cost of such removal shall be charged on the tax roll against the property.

C. The Chief shall keep a written record card of each property inspected which shall conform to the requirements of the Wisconsin Department of Commerce and shall make the quarterly report of inspections required by the Department of Commerce.

D. No person shall deny the Chief or his deputies free access to any property within the Town at any reasonable time for the purpose of making fire inspections. No person shall hinder or obstruct the Fire Inspector in the performance of his duty or refuse to observe any lawful direction given by him.

E. Frequency of building and business preventative fire inspections will be at least once annually in accordance with § SPS 314.01 (13.7), Wis. Adm. Code. Where violations are found, a Woodruff Fire Inspector will conduct a follow-up to assure compliance within two calendar months of the violation date. Noncompliance with the fire inspection will result in further actions taken by the Town of Woodruff specific to Ch. SPS 314, Wis. Adm. Code.

§ 286-2 Codes adopted.

A. The following provisions of the Wisconsin Administrative Code are hereby adopted by reference:

(1) Chapter Comm 10, Flammable and Combustible Liquids.

(2) Chapter Comm 40, Gas Systems.

(3) Chapters Comm 61 to 65, Commercial Building Code.

(4) Chapters Comm 75 to 79, Existing Buildings.

B. The following provisions of the National Fire Protection Association (NFPA) are hereby adopted by reference:

(1) NFPA 10, Standard for Portable Fire Extinguishers.

(2) NFPA 13, Automatic Sprinkler Systems.

(3) NFPA 30, Underground Tanks and Piping.

(4) NFPA 58, Liquefied Petroleum Gases.

(5) NFPA 73, Municipal Alarm Systems.

(6) NFPA 211, Chimneys, Fireplaces, Vents and Solid Fuel Burning Appliances.

(7) NFPA 385, Tank Vehicles for Flammable and Combustible Liquids.

C. National Electric Code (NEC) Articles 110 to 700, as recognized by the Department of Commerce, are hereby adopted by reference.

§ 286-3 Chimney fires.

Chimneys and vents which have been subjected to a chimney fire shall not be reused until inspected and approved by the Fire Department or an authorized agent. This approval shall be in writing.

§ 286-4 Careless smoking.

Any owner or operator of a business held open to the public who allows or suffers the unsafe use or disposal of smoking materials by patrons and employees which results in a fire shall be responsible for the entire costs of Fire Department response to such fire, in addition to any other penalties imposed.

§ 286-5 Violations and penalties.

Except as otherwise provided, any person found to be in violation of any provisions of this chapter shall be subject to a penalty as provided in § 1-3 of this Code.
