A. 
Purpose. This article shall enforce the design, specifications, procedures and maintenance of sidewalks, curbs, gutter and parkways in the Town.
B. 
Legislative authority. Section 60.50, Wis. Stats., authorizes the Town Board to provide for the construction, removal, replacement or repair of sidewalks under § 66.0907, Wis. Stats.
C. 
Application. This article applies to all sidewalks, parkways, curbs and gutters in the Town. No sidewalk, parkway or curb and gutter shall hereafter be constructed without the permission of the Town Board and compliance with this article.
The following definitions shall be applicable in this article:
BOARD OF PUBLIC WORKS
The committee or officer appointed by the Town Board who or which is designated to handle street or sidewalk matters.[1]
CURB
The concrete border forming part of the gutter along the edge of the street or road.
GUTTER
The concrete channel for draining off water at the edge of a street or road.
PARKWAY
The grassy and often landscaped area between the sidewalk and the curb.
SIDEWALK
The concrete path for pedestrians along the side of a street or road.

The Town Board finds that excessively poor quality and dissimilarity of the existing sidewalks, curbs, gutters and parkways and the area without any sidewalks, curbs, gutters and parkways adversely affect the general welfare of its residents and visitors and thereby impairs Woodruff's tradition of being a pedestrian-oriented community. It is the intent of this article to list design guidelines, set forth specifications, procedures and timing, alleviate problems for the handicapped and enhance the character, beauty and general welfare of the Town.
A. 
Town Board. By ordinance or resolution the Town Board may determine where sidewalks, curbs and gutters and parkways shall be constructed and establish width, determine materials to be used, and prescribe method of construction and the timing of such construction.
B. 
Board of Public Works. The Board of Public Works may order any existing sidewalk, curb and gutter or parkway which is unsafe, defective or insufficient to be repaired, removed or replaced or a new sidewalk, curb and gutter or parkway to be constructed where none previously existed, in accordance with the standards fixed by the Town Board.
If the Town Board orders a new sidewalk, curb and gutter or parkway to be constructed or any existing sidewalk, curb and gutter or parkway or portion thereof to be replaced, removed or repaired at the expense in whole of the owner of the abutting property, notice in writing shall be given to the owner under § 66.0907(3)(e), Wis. Stats. Such notice shall be in the name of the Town Board and shall be signed by the Town Clerk as ordered by the Town Board.[1]
A. 
Whenever any owner neglects for a period of 20 days after notice to lay, remove, construct, replace or repair any sidewalk, curb and gutter or parkway as required by such order, the Town may do the work directly, or may cause the work to be done, at the expense of the owner in either case.
B. 
The cost of such work in front of each parcel of land shall, if not previously paid, be levied as a special tax against such parcel and collected as other taxes on real estate are collected as provided by the Wisconsin Statutes.
C. 
If any owner fails or neglects to keep any sidewalk or parkway free of debris, obstruction, dirt, sweepings, snow and ice, the Town may proceed to clear such sidewalk and shall charge the expenses thereof as a special tax against the premises to be collected as other taxes on real estate. The Town Board shall give notice to the property owner, and after three days, if the property owner has not complied, the Town shall do the work at the expense of the property owner.

Variances will be considered upon appeal made to the Town Board.
The cost of construction and maintenance for sidewalks, curbs and gutters and parkways shall be at the expense of the abutting property owner.
A. 
When no special order as to width of the new or replacement sidewalk shall have been made by the Town Board, the width thereof shall be as follows:
(1) 
New sidewalks. New sidewalks in blocks where no sidewalks previously existed shall be as follows:
(a) 
On streets 60 feet or more in width: five feet wide.
(b) 
On streets less than 60 feet in width: four feet wide.
(c) 
With the written permission of the Town Board, the sidewalk abutting property located in a business or commercial zone may be extended to the curb, where concrete curbing has been installed.
(2) 
New or replacement sidewalk. New or replacement sidewalks in blocks where sidewalks have previously existed in part or all of the block shall be of the same width as the previously existing sidewalks, provided that when the sidewalk shall be installed or replaced or ordered to be installed or replaced along an entire block, the provisions of Subsection A(1) shall apply.
B. 
All sidewalks and pedestrianways must be constructed of concrete. Construction with any other material must be approved by the Town Board.
(1) 
The subgrade shall be free from all organic matter, of a uniform grade, well compacted and well drained. Any soft or mucky spots shall be removed and filled with sand, gravel or other similar material.
(2) 
The surface of the subgrade shall be at or above the adjacent finished surface grade.
(3) 
Where possible there shall be four inches of compacted granular fill with a maximum size of one inch. However, in all cases there shall be a minimum of four inches of cement.
(4) 
The subgrade, where possible, shall extend 12 inches beyond the cement slab edge.
(5) 
There shall be no more than a four-inch slump.
(6) 
Cement mix should be between 520 and 560 pounds per cubic yard (six bags - 564 pounds).
(7) 
There should be approximately 6% air entrainment.
(8) 
The surface shall be slightly textured with a broom or other appropriate device to prevent a slippery surface when wet.
(9) 
Construction joints must be at minimum intervals of every six feet. Sidewalks over 10 feet wide shall have a contraction joint down the center. The contraction joint should be 1/4 to 1/5 of the slab thickness.
(10) 
Any panels formed by control joints shall not have a length/width ratio of more than 1.5 to one.
(11) 
Expansion joints extending the full depth of the slab or below it shall be located at potential points of stress where the concrete meets rigid or relatively fixed objects, such as a building, curb, manhole, fireplug, parking meter, post, etc. The material used shall be no less than 1/4 inch thick.
(12) 
Final cleanup shall consist of removal of all concrete, rubble, excess fill, and any and all foreign material resulting from the sidewalk construction. Cleanup shall be completed within 24 hours after the forms have been removed.
C. 
Maintenance. The owner of property abutting on any sidewalk shall, without notice and at all times, keep such abutting sidewalks clean and free of snow and ice and shall not deposit or place any sweepings or debris or other foreign matter upon the same.
D. 
Curb ramping. The standard for construction of curbs and sidewalks on each side or one side of any street or road within the Town or any connecting highway or Town road for which curbs and sidewalks have been prescribed by the Town Board having jurisdiction thereover shall include curb ramping providing access to crosswalks at intersections and other designated locations. Curb ramping includes the curb opening, the ramp and that part of the sidewalk or apron leading to and adjacent to the curb opening. Any person constructing new curbs or sidewalks or replacing curbs and sidewalks within five feet of a legal crosswalk in any Town street or road shall comply with the standards of curb ramping under § 66.0909, Wis. Stats.
A. 
A curb and gutter shall be installed when a street is improved with permanent paving assessed to abutting properties, unless the Town Board determines that the general welfare and safety of the public do not require curb and gutter after considering the characteristics of the neighborhood, including but not limited to the area drainage system, soil conditions and street width.
(1) 
The preparation of foundation shall include removal of trees, roots, stumps, concrete or asphalt driveway approaches, existing curb and gutter or other physical objects which would prohibit the construction of this masonry structure.
(2) 
The foundation or material underlying the proposed curb and gutter shall be compacted thoroughly and finished to a firm, true surface.
(3) 
All fills shall be installed in six-inch layers of suitable materials approved by the Town Board and each layer thoroughly compacted to at least 95% of the maximum density at optimum moisture.
(4) 
Forms shall be made of wood or metal and shall be straight and of sufficient strength to resist springing, tipping or other displacement during the process of depositing and consolidating the concrete. The forms shall be of the full depth of the required curb, gutter or combination curb and gutter sections and shall be of such design as to permit secure fastening. All forms shall be cleaned thoroughly and oiled before the concrete is placed against them.
(5) 
The following conditions in relation to the setting of form shall be met unless approval otherwise is obtained from the Town Board:
(a) 
Complete form placing and staking shall be checked and approved by the Board of Public Works.
(b) 
A minimum distance of 200 feet or to the end of the block, including its end radius, shall be formed.
(c) 
Curved sections shall be formed at the same time as the straight sections.
(6) 
Concrete curb, gutter and combination curb and gutter shall be securely anchored to the adjoining pavement by placing of specified tie bars. Steel separators of a section conforming to the true contour of the curb face shall so far as practicable be placed in curb, gutter or combination curb and gutter directly opposite all construction or contraction joints in abutting concrete pavement. The spacing of intermediate separator joints shall be such that each monolithic section of curb, gutter or combination curb and gutter will be not less than six feet nor greater than approximately 20 feet in length. The concrete shall be deposited to the proper depths, thoroughly consolidated, spaded against the forms and struck off and finished to the required section. Separators shall be removed as soon as practicable after the concrete has been struck off, consolidated and set sufficiently to preserve the width and shape of the joint.
(7) 
The face surfaces of the curb and gutter or combination curb and gutter shall be thoroughly troweled and brushed. Unless otherwise provided, the back edge of the curbs, the edge of the gutter adjacent to the pavement and edges adjacent to expansion joints or contraction joints formed by separator plates shall be rounded with an edger of one-fourth-inch radius.
(8) 
Expansion joints shall be placed in the curb, gutter and combination curb and gutter directly opposite the expansion joints in abutting pavement, and, unless otherwise provided, such joints shall be of the same type and thickness as the joints in the pavement. Joints shall be set at right angles to the face and top of the curb and at right angles to the flow line and surface of gutters. At street intersections a three-fourths-inch expansion joint shall be placed in the curb, gutter and combination curb and gutter where the tangent and radial curb and gutter meet, at midblock where the block length exceeds 40 feet or at four-hundred-foot intervals. The joint shall fit snugly against the subgrade and shall extend upward to an elevation of 1/4 inch below filler and shall conform to the true contour of the curb and gutter section.
(9) 
All expansion, contraction and contact joints shall be cleaned thoroughly of all temporary filler, dirt, water and other foreign material and sealed with a hot poured elastic material. The exposed surface shall be finished smooth and even.
(10) 
All concrete surface shall be sealed by spraying on it a uniform coating of curing material in such a manner as to provide a continuous water-impermeable film on the entire concrete surface.
(11) 
After the curb and gutter have been cured and the forms are removed, the spaces along the back of the curb, between the curb and existing sidewalk or between the curb and the street property line, if sidewalk is not existing, shall be backfilled with materials satisfactory with the Town Board.
(12) 
Final cleanup shall consist of removal of all concrete rubble, excess fill, and any and all foreign material resulting from the curb and gutter construction.
B. 
Maintenance. The abutting property owner is responsible for all maintenance of curbs and gutters.
C. 
Cost of construction. The cost of constructing or repairing curbs and gutters will be assessed to the abutting property owner.
A. 
Cost. Whenever curbing has been installed and a parkway provided between the sidewalk and the curb, such parkway area shall be improved by the owner of the premises abutting thereon.
B. 
Maintenance. Whenever curbing has been installed and a parkway provided between the sidewalk and the curb, such parkway area shall be maintained by the owner of the premises abutting thereon at such grade in such condition so as to provide adequate drainage of the sidewalk and parkway area.
Any person found to be in violation of any provision of this article shall be subject to a penalty as provided in § 1-3 of this Code, and each day's failure to comply with any provision shall constitute a separate violation (§ 66.0109, Wis. Stats.).
