No person or persons shall be permitted to engage in or carry on the trade, business or calling of employing plumbers, or as master of plumbers in the Village of Island Park, unless such person or persons shall have secured a license from the Village Clerk of said Village upon the payment of a fee as set from time to time by the Board of Trustees to cover the cost of the license.
The license may be renewed each year upon payment of a renewal fee as set from time to time by the Board of Trustees, along with the necessary insurance and workers' compensation requirements.
All plumbing fixtures, gas conversions, and applications to maintain existing fixtures will require a plumbing permit along with payment of the associated fees as per the schedule set from time to time by the Board of Trustees.
These fees are subject to change by resolution of the Board of Trustees.
Such license shall be issued to any plumber or master plumber who shall exhibit to the Village Clerk a license that has been issued by the Town of Hempstead for such person to operate as a plumber in any area covered by said town.
It shall be unlawful for any person, corporation or copartnership in the Village of Island Park, unless said person, corporation or copartnership shall have complied with the requirements of this chapter, to hold himself or itself out to the public as a master plumber or employing plumber by the use of the work "plumber" or "plumbing" or words of similar import or meaning on signs, cards, stationery, or any other manner whatsoever.
It shall be unlawful for any person, corporation or copartnership in the Village of Island Park to engage in or carry on the trade, business or calling or employing of plumbers or master plumbers unless such person, corporation or copartnership has specifically posted in the window of the place where such business is conducted a plate or sign properly lettered and marked "licensed plumber" in accordance with the rules adopted by the Board of Trustees of this Village.
No person, corporation or copartnership registered as provided in this chapter shall engage in the plumbing business, apply for, receive or make use of any permit granted to him by reason of being so registered or holding such certificate for the benefit of any person who is not so registered.
No person, corporation or copartnership shall install, alter or repair, or cause to be installed, altered or repaired any plumbing or plumbing installation within the Village of Island Park except a person, corporation or copartnership holding a plumber's license as a registered plumber issued by the Village of Island Park, as set forth in this chapter.
A corporation may install, alter or repair or cause to be installed, altered, or repaired any plumbing installation, provided such work is done pursuant to the direction and supervision of an officer of such corporation duly licensed and registered as a plumber pursuant to this chapter.
This chapter shall not apply to any employee of the federal government doing governmental work, or of the State of New York, or any political subdivision thereof when employed in the business of the State of New York, or such political subdivision; nor shall this chapter apply to any owner of premises or tenant thereof doing work in washers, cleaning traps, fixing leaks in the hot and cold water lines or in the hot water tanks, or replacing defective parts in hot water tanks, or such other minor repairs as shall not affect the health of the persons in the premises or of the people residing in the neighborhood.
Any person or persons so employing plumbers or master plumbers carrying on their trade, business or occupation as plumber in the Village of Island Park shall apply for such license prior to any plumbing work to be doing in said Village. The license fee, as set forth in this chapter, shall be for a period of one year ending December 31 of each year thereof. Such registration may be canceled by the Board of Trustees of this Village for a violation of the rules and regulations for plumbing or plumbing installation as may be adopted by said Board of Trustees for said Village or in force at the time of the enactment of this chapter. Such cancellation shall be upon notice to the registrant of not less than 10 days prior to any hearing to be held by the Board of Trustees.
All plumbing, installations, alterations or repairs hereafter made, installed, altered or repaired in the Village of Island Park shall be in conformity with the Plumbing Code of the State of New York and any amendments thereto.
Every plumber shall file with the Village Clerk before beginning operations under his license, and upon each renewal of said license, a policy of liability insurance, issued by an insurance company licensed to do business in the State of New York, and which is approved by said Village Clerk, insuring, indemnifying and saving harmless the Village of Island Park of and from all damages or claims for damage to a public sewer, water service mains or pipes, to a highway or the surface thereof, to public or private property or to any person arising from unlawful or negligent acts or omissions of said plumber, his agents or employees, or any person operating under the authority of his license, in making connection with a public sewer; in opening a public sewer; or in making an opening or excavation in a public highway, public square or public park or in maintaining, guarding, refilling, or working in or about such opening or excavation or in maintaining or guarding objects or materials taken from such opening or excavation or used in connection therewith. Each such policy of liability insurance shall provide against loss from the liability imposed by law for damages, including damages for care and loss of services, because of bodily injury to or death of any person and injury to or destruction of property arising out of the aforesaid activities of such plumber, subject to a limit, exclusive of interests and costs, of $300,000 because of bodily injuries to and/or death of person or persons in any one action, and of $50,000 because of injury to or destruction of property of others, including the Village. Every plumber shall also file with the Village Clerk, in a form acceptable to said Clerk, proof that he has in force and in effect insurance required under the Workers Compensation Law.
Every person found guilty of violating any of the provisions hereof shall, upon conviction thereof, be liable to be punished by a fine of not less than $50 nor more than $250 or to imprisonment for not more than 15 days, or to both such fine and imprisonment in the discretion of the court.
