This chapter shall be known as the "Village of Webster Mandatory
Lead Paint Notification Act."
The Village of Webster believes that unintentional contact with
lead paint particles and residue constitutes a potential public health
threat.
This chapter shall apply to the following zones: Central Business
(CB); Residential Multiple (RM); Neighborhood Business (N-B); Planned
Unit Development (PUD); and General Industrial (G-I).
This chapter shall only apply if the paint removal disturbs
a total area greater than two square feet for any given project area.
A.
Prior
notification of lead paint removal. At least 48 hours prior to any
lead paint removal, the person or business performing such removal
shall, through written notice, inform all persons or businesses within
300 feet, including all households within a multiple-family dwelling.
B.
Notification
need not be made if, not later than one week prior to the removal
of the paint, the person or business performing such removal has filed
written certification that such paint to be removed was applied subsequent
to 1978.
A.
The
Building Inspector or other code enforcement official shall enforce
this chapter.
B.
Any
person or business that violates this chapter shall be guilty of a
violation, and upon conviction, shall be punishable by a maximum fine
of $250 or by imprisonment for not more than 15 days, or both. Each
day's violation shall constitute a separate offense.
