No owner-occupied residential real property consisting of four or fewer dwelling units may be acquired by eminent domain by the Town of Fairfield for economic development purposes pursuant to Chapters 130 or 132 of the Connecticut General Statutes if the resulting project will be owned or independently controlled by a private or nongovernmental entity.
Nothing contained herein shall be construed to limit the use of eminent domain powers for public purposes, including, but not limited to, the construction of schools, public buildings, sewers, highways, public roads, sidewalks, rights-of-way, flood, shore and erosion control purposes or for any other transaction where the property rights acquired will be held or controlled by the Town of Fairfield, the State of Connecticut or the federal government.
This chapter shall not conflict with any subsequently enacted state or federal law on this subject matter.
