The position of Borough Administrator of the
Borough of South River is hereby created, and the employment of a
person professionally trained and educated who shall qualify by such
requirements generally recognized by the Professional Organization
of Municipal Administrators in order to fill such position is hereby
authorized. The position of Administrator shall be full-time or part-time
as determined by the Borough Council, and in the event that said Administrator's
position is full-time the Administrator shall devote full-time to
the interest of the Borough. The Administrator shall be allowed to
conduct consulting services for other private or public entities so
long as such consultations do not cause a conflict with the Borough
of South River and does not in any way interfere with the Administrator
conducting his duties and responsibilities for the Borough of South
River which shall be considered his primary employer.
A.Â
The Borough Administrator shall perform the following
duties. He shall:
(1)Â
Serve as the chief administrative officer of the Borough.
(2)Â
Attend all meetings of the Mayor and Council and such
other meetings, whether within or without the Borough of South River,
as he may be assigned, from time to time, by the Mayor and Council.
(3)Â
Provide a liaison between the Mayor and Council and
the various municipal boards, agencies and departments of the Borough
of South River and its professional advisors.
(4)Â
Execute all laws and ordinances of the Borough, subject
to the direction of the Mayor and Council.
(5)Â
Keep the Mayor and Council currently informed on all
matters assigned to him or otherwise within his jurisdiction.
(6)Â
Be responsible for the coordination of interdepartmental
operations.
(7)Â
Negotiate contracts, subject to the approval of the
Council.
(8)Â
Make recommendations concerning the nature and location
of Borough improvements as determined by the Council.
(9)Â
Recommend to the Council for adoption such measures
as he may deem necessary or expedient.
(10)Â
Make studies and surveys of such municipal problems
of the Borough of South River as shall be assigned to him, from time
to time, by the Mayor and Council and prepare and submit written reports
of his findings and determinations to the Mayor and Council for its
consideration and action.
(11)Â
Study continually present and future budgets, purchasing
procedures, administrative procedures and personnel organization and
policies and make such recommendations to the Mayor and Council relating
thereto as he shall deem necessary from time to time.
(12)Â
Be responsible for continually improving communications
between the various Borough personnel, departments, agencies and boards
and between such personnel, departments, agencies, boards and the
Mayor and Council.

Make such inspections and reviews as may be necessary
to ensure all compliance by all persons and corporations having contractual
obligations to perform services for or sell goods to the Borough of
South River.
(14)Â
Be responsible for the compiling, editing and prompt
dissemination and release of public information, upon the authorization
of the Mayor and Council.
(15)Â
Act as the Borough's representative to the Middlesex
County Joint Insurance Fund, attend all meetings with respect thereto
and assume any other duties with respect to said position.

(16)Â
Be responsible for the overall supervision and maintenance
of real property owned by the Borough of South River.
(17)Â
Act as liaison between the Borough of South River
and the various county, state and federal agencies, with respect to
all applications for funds and/or services needed or required by the
Borough of South River.
(18)Â
Be responsible to see that any complaints concerning
the functions and obligations of the Borough of South River made by
any of its residents, are promptly attended to and a written record
kept of such complaints, when made and when and what action was taken
in response thereto, as well as provide information and assistance
in respect to such complaints.

Perform such other administrative and ministerial
duties and functions as may be assigned to him by the Mayor and Council.
(20)Â
Make any recommendations which he may believe will
increase the efficiency of the administrative operation of the Borough
of South River.
(21)Â
Make any and all reports necessary to the Mayor and
Council, including monthly reports, and at the close of the year,
make an annual report of Borough government activities and cause the
Chief Financial Officer to make monthly financial reports to the governing
body.

B.Â
No duty set forth herein shall be deemed to authorize
the performance or interference, in any way, with the duties and functions
of any other municipal official or employee, nor shall such any other
municipal official or employee be relieved of any of his responsibilities
or duties heretofore assigned or prescribed by law.
The Borough Administrator shall receive as compensation
for his services an annual salary which shall be fixed in accordance
with the provisions of the ordinance governing salaries.

Said Borough Administrator shall be appointed
by the Mayor with the advice and consent of the Borough Council for
an indefinite term and may not be removed except in accordance with
the statute in such case made and provided.
The Borough Administrator shall report to the
Mayor and the Borough Council administratively.
The Administrator may be removed by a majority
vote of the authorized membership. The resolution of removal shall
become effective three months after its adoption by the Council. The
Council may provide that the resolution shall have immediate effect;
provided, however, that the Council shall cause to be paid to the
Administrator forthwith any unpaid balance of his salary for the next
three calendar months following adoption of the resolution.
The Borough Administrator shall be chosen on
the basis of his executive and administrative abilities and qualifications,
with special regard to education, training and experience in governmental
affairs.

In addition to the foregoing, the Borough Administrator
shall be responsible for the following:
A.Â
Investigating the affairs of any officer or department.
B.Â
Establishing and maintaining sound personnel policies
and practices and maintaining appropriate personnel records of all
employees.
C.Â
Assist the Chief Financial Officer and Auditor in
preparing the annual operating capital budgets and directing them
to be submitted to the Council at a date in accordance with the procedures
established by the governing body.
D.Â
Acting as the authorizing officer with respect to
all vouchers and bills submitted to the Mayor and Council for final
approval.

The Administrator is hereby entitled to vacation,
personal leave and sick leave as set forth in the Borough Administrator's
contract in effect during his term of employment.

A.Â
In the event
the Borough Administrator is unable to perform his/her duties due
to vacation, ill health, leave of absence, suspension or any other
reason, then and in that event, the Chief Financial Officer shall
assume the duties and responsibilities of the Borough Administrator
until such time as the Borough Administrator shall resume the duties
of the office or for a period of no longer than 30 consecutive days.
The Chief Financial Officer shall be paid a stipend in the amount
of $200 per day during the absence.
B.Â
In the event
the Chief Financial Officer is also unavailable and is unable to perform
the duties as Acting Borough Administrator due to vacation, ill health,
leave of absence, suspension or any other reason, the Mayor is hereby
authorized to immediately make an interim acting appointment from
the employees of the Borough as is necessary to ensure that the functions
of the office of Borough Administrator will continue uninterrupted
until either the Borough Administrator or the Chief Financial Officer
shall again be available for performance of his duties. Such appointment
shall only be effective for no longer than 30 consecutive days. The
Interim Acting Administrator shall be paid a stipend in the amount
of $200 per day during the absence.
C.Â
In the
event the position of Borough Administrator is vacant or there is
an anticipated absence of the Borough Administrator for more than
30 consecutive days, the Mayor is hereby authorized to immediately
make an Acting Administrator Appointment as is necessary to ensure
that the functions of the office of Borough Administrator will continue
uninterrupted. The Acting Business Administrator shall be compensated
pursuant to an employment agreement with the Borough.
