A Municipal Court for the Borough of South River is established as of January 1, 1949, pursuant to the provisions of N.J.S.A. 2B:12-1 et seq.
The name of the Municipal Court shall be the "Municipal Court of South River."
The Municipal Court shall have a seal which shall bear the impress and name of the Court.
There shall be a Judge of the Municipal Court, who shall be appointed by the Mayor with the advice and consent of the Borough Council and who shall serve for a term of three years from the date of his appointment and until his successor is appointed and qualified; provided, however, that the present Recorder who shall be in office upon this article's becoming effective shall be the Judge of the Municipal Court and shall continue to be such Judge for a term equal to the balance of the term for which he was originally appointed.

The compensation of the said Judge, Municipal Court Administrator, and such Clerks or other personnel as may be required to administer the functions of the Municipal Court shall be such sums as may be provided for by the annual ordinance pertaining to the salaries and compensation of all Borough officials and employees.[1]

The said Municipal Court and the Judge thereof shall have, possess and exercise all the functions, powers, duties and jurisdiction conferred by the provisions of N.J.S.A. 2B:12-1 et seq. or by any other law.

A. 
The governing body of the Borough of South River may, by appropriate ordinance or resolution, at such time as the need may arise, provide for a Municipal Court Administrator and other personnel as may be necessary for the efficient administration of the Municipal Court.
B. 
Qualifications for employment. Notwithstanding anything hereinafter to the contrary, any employee and/or personnel assigned and/or designated an employee of the Municipal Court of the Borough of South River must submit to a records check as a condition of employment. Said records check shall consist of a check of the Division of Motor Vehicle records, State Police records and National Crime Information Center records. The cost of said records check shall be at the sole expense of the Municipal Court of the Borough of South River.

Said records check shall be coordinated by the Municipal Court Judge or the Municipal Court Administrator and/or Deputy Municipal Court Administrator.
(2) 
Copies of said records check shall be available to the Municipal Court Judge, the Municipal Court Administrator and/or Deputy Municipal Court Administrator and the Borough Clerk.
(3) 
A successful completion of the records check shall be considered a condition of employment for any and all Municipal Court employees hired after May 14, 1991.
The Municipal Court shall be held in the Borough Hall. The Judge shall sit on such days and for such periods of time as may be designated by the Commissioner of Police and at such other times as the business of the Court may require, subject to the rules applicable to municipal courts.
