A. 
The Mayor and Councilmen of the Borough shall constitute the Council thereof. They shall hold an annual meeting on January 1 at 12:00 noon or during the first seven days of January in any year and such other meetings or adjourned meetings at such time and place as they may by resolution direct, but all regular meetings shall be held within the Borough. The Mayor shall, when necessary, call special meetings of the Council; in case of his neglect or refusal, any four members of the Council may call such meeting at such time and place in such Borough as they may designate, and in all cases of special meetings notice shall be given to all the members of the Council or left at their place of residence.
B. 
Three Councilmen and the Mayor, or, in the absence of the Mayor, four Councilmen, shall constitute a quorum for the transaction of business; but a smaller number may meet and adjourn from time to time.
C. 
The Mayor shall preside over all meetings except as in this article otherwise provided, but shall not vote except to give the deciding vote in case of a tie.
D. 
In addition to the order of business set forth in the Rules of Council which may be adopted by the governing body from time to time, there shall be an item of business consisting of a consent agenda resolution. These resolutions shall be resolutions of a routine and noncontroversial nature needing little, if any, discussion. Consent agenda resolutions shall not be discussed separately by the governing body, but may be discussed by the public in the public portion of a Council meeting, or the resolution may be removed from the consent agenda if any member of the governing body, including the Mayor, so requests or if the unanimous consent of the governing body cannot be attained for placement of a resolution on the consent agenda. Resolutions to be placed on the consent agenda shall be discussed at the Council business meeting preceding the regular meeting, and, if necessary, a vote shall be taken to place the resolutions on said consent agenda.

E. 
The order of business set forth in the Rules of Council adopted by the governing body shall provide for public comment or discussion. When recognized by the Mayor or other presiding officer, the person so recognized shall proceed to the floor and give his or her name and address. Unless further time is granted by the governing body, the person so recognized shall limit his or her statement or questions to 10 minutes, which period shall be inclusive of any response requested from the governing body. Statements or questions shall be addressed to the governing body as a whole and not to any member thereof.

The Council at its annual meeting shall, by the vote of a majority of said Council, elect from its number a President of the Council, who shall preside at all its meetings when the Mayor does not preside. He shall hold office for one year and until the next annual meeting. He shall have the right to debate and vote on all questions before the Council. If the Council at its annual meeting fails to elect a President, the Mayor shall appoint the President from the Council, and in that case no confirmation by the Council shall be necessary.
If the Mayor is absent from the Borough for a period of three days or for any reason is unable to act, the President of the Council shall perform all the duties of the Mayor during such absence or inability. The Mayor, in case of his intended absence from the Borough for more than three days at any one time, shall notify the President in writing of such intended absence, whereupon the President shall be and become Acting Mayor from the receipt of such notice and continue to act until the Mayor's return. In case of the temporary inability of said President of Council to so act, the member of Council having the longest term of service as such may act temporarily for said President of Council.
The Council may make, amend, repeal and enforce ordinances in accordance with the authority conferred by Subtitle 3 of Title 40, N.J.S.A. 40:42-1 et seq., and N.J.S.A. 40:88-4.
The Council shall possess all the power relating to licenses issuable by the Borough now or hereafter conferred on municipalities by Chapter 52 of Title 40 (N.J.S.A. 40:52-1 et seq.) or any other law, but no person shall be required to take out a license in order to sell at wholesale or to sell any produce of his farm.
The Council may prescribe penalties for the violation of the ordinances it is authorized to pass and may enforce the same in the manner prescribed in and subject to the provisions of N.J.S.A. 40:49-5.
