No person or persons, firm or corporation shall engage in the business of junk shop keeper or junk dealer in the Borough of South River without first obtaining a license to do so.
The terms "junk shop keeper" and "junk dealer" shall mean and describe any person or persons, firm or corporation engaged in the business of storing, displaying, buying or selling old junk, old rope, old iron, brass, tin, lead or other materials, old automobile cars or other abandoned or nonusable vehicles, old bottles and the like.
All persons, firms or corporations now engaged in or hereafter engaging in the business of junk shop keeper or junk dealer shall, from and after the effective date of this chapter, make application for a license to the Borough Clerk, who is hereby designated as the licensing officer for the purpose of this chapter. Said application shall be in writing and shall set forth the name of the person or persons, firm or corporation, their respective addresses or principal place of business, and shall describe the premises upon which said business is to be conducted, giving the street frontage and approximate depth of said premises, and the said application shall be accompanied by the license fee hereinafter provided.
The Borough Clerk is hereby directed to present said application to the Borough Council at its next meeting and is hereby authorized to issue a license to such person or persons, firm or corporation upon approval of the same by the Borough Council, and said license shall be effective from the date of issue to the 31st day of December of the year in which said license is issued.

Upon the expiration of any license granted them hereunder, all persons, firms and corporations shall, on or before the first day of January of each year, make application to the Borough Clerk for a license to conduct said business for the ensuing year or part thereof, in the manner set forth in § 198-3 hereinabove; provided, however, that no license shall be issued except as set forth in § 198-4 hereinabove.

Every person or persons, firm or corporation shall, upon making application for such license, pay to the Borough of South River an annual license fee as provided in Chapter 155, Fees; provided, however, that said fee shall be returned to the applicant in the event that the Borough Council fails to approve said application, and provided further that if any application for said license is made after July 1 in any year, a license may be issued for the remainder of such year upon the payment of 1/2 of said license fee.
No license issued hereunder shall entitle such licensee to operate thereunder at or in any lot, building or location other than that specified in the said license.
No licensee hereunder shall receive in the line of his, her or its business any article or thing by way of pledge or pawn, nor shall be, she or it advance any sum or sums of money on the security of any such article or thing.
No licensee hereunder shall purchase any goods, articles or other things whatsoever from any person under the age of 15 years.

A. 
Any junk shop which may be conducted on an open lot in the Borough of South River shall have said lot fenced in by a solid board fence not less than seven feet in height, and such fence shall be set back at least 20 feet from any municipal, county or state highway near which it is located.
B. 
Said fence shall be painted white and shall be kept neat and in good repair. No signs of any kind shall be painted or posted upon said fence excepting a business sign advertising the junkyard, not to exceed in size a portion of said fence 10 feet in width, facing each abutting street. None of the materials described in § 198-2 of this chapter shall be stored or displayed in the open within said junkyard at a height exceeding seven feet.
No junk, old rope, old iron, brass, copper, tin, lead or other metal, rags, old bottles and the like shall be kept on any sidewalk of the Borough of South River or in front of the place of business conducted by the licensee as a junk shop.
All flammable material stored on the premises shall be kept or placed in a fireproof building or room, and any articles of junk so designed as to collect and hold rainwater if left exposed in the open shall be housed in a watertight building, and no articles shall be stored or piled in such manner as to create a fire hazard or create a place for the harboring and breeding of rats, mice or vermin.
Every person or persons, firm or corporation licensed hereunder shall be entitled to keep one cart, wagon, truck or other vehicle for the purpose of collecting the junk articles above mentioned; provided, however, that if said licensee desires to keep more than one cart, wagon, truck or other vehicle, the licensee, for the privilege of keeping the same, shall pay to the Borough Clerk the sum as provided in Chapter 155, Fees, and provided also that said licensee shall cause to be painted in legible fashion on the outside of every such cart, wagon, truck or other vehicle the name of the licensee and the street and number of licensee's place of business, and said licensee shall affix to one side of every such cart, wagon, truck or other vehicle a metal tag bearing the number of such licensee, which tags shall be furnished by the Borough.
Every person engaged in drawing or driving any such cart, wagon, truck or other vehicle shall at all times carry with him when so engaged the license issued for such cart, wagon, truck or other vehicle whereby such conveyance is authorized, and shall exhibit the same on demand to any police officer of the Borough of South River.
No person or persons except such as are duly licensed under this chapter or as are in the regular employ of such licensee shall draw or drive or cause to be drawn or driven any such cart, wagon, truck or other vehicle for the purposes of collecting any articles of junk.
Every licensee hereunder who shall receive or be in possession of any goods, articles or things which may have been or are lost or stolen shall forthwith on demand to view the same present the same to the police authorities of the Borough of South River.
The Borough Clerk, upon the issuance of any licenses under the provisions of this chapter, shall turn over said license fees to the Borough Treasurer.
The Health Officer designated by the Board of Health of the Borough of South River is hereby authorized and directed, during reasonable business hours, to make reasonably periodic and effective inspection of all of the premises and buildings used for the purposes hereinabove described, for the purpose of ascertaining that the business is being conducted on the licensed premises in accordance with the provisions hereof.
This chapter is adopted for the purpose of raising revenue and regulating the business hereinabove referred to.

Any person or persons, firm or corporation violating or refusing or neglecting to comply with any of the provisions of this chapter shall be liable, upon conviction, to the penalties provided in Chapter 1, Article I, General Penalty.
