As used in this chapter, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Any liquid intended for human consumption having an alcoholic content, regardless of the amount of said content, including but not limited to beer, wine and all types of whiskey.

Except as provided in § 35-5, it shall be unlawful, and it is hereby prohibited for any person in, on, upon or within any public street, sidewalk, thoroughfare, alley, walkway, playground or public property in the Borough of West Conshohocken, whether in a motor vehicle or as a pedestrian, to drink or consume an alcoholic beverage.

Except as provided in § 35-5, it shall be unlawful, and it is hereby prohibited for any person in, on, upon or within a public street, sidewalk, thoroughfare, alley, walkway, playground or public property in the Borough of West Conshohocken, whether in a motor vehicle or as a pedestrian to carry, transport or have control of any alcoholic beverage except in the original package which shall not have been opened.

Any person violating the provisions of this chapter shall be subject to the provisions detailed in Chapter 53A of the Code of the Borough of West Conshohocken.

The prohibitions provided in §§ 35-2 and 35-3 may be waived upon application to the Borough Council. Borough Council may adopt, by resolution, regulations, rules and restrictions on waivers granted pursuant to this section.
