Except within the confines of any building, it shall be unlawful for any person or persons to cause, suffer or permit the burning of any materials on either public or private property within the Borough of West Conshohocken, nor shall burning be permitted within any garage, storage building or temporary building.
The requirements of § 71-1 of this chapter shall not apply where open burning results from:
A. 
Any fire set to prevent or abate a fire hazard, when approved by the Pennsylvania Department of Environmental Resources and when set by or under the supervision of the West Conshohocken Fire Marshal.
B. 
Any fire set for the prevention and control of disease or pests, when approved by the Pennsylvania Department of Environmental Resources.
C. 
Any fire set for the purpose of instructing personnel in firefighting, when approved by the Department of Environmental Resources.
D. 
The usual use of barbecues or outside fireplaces for the cooking of food, but only with gas, charcoal or wood.
No burning shall be done except at a reasonable and safe distance from buildings and with a responsible person in constant attendance, nor shall any burning be done which causes any nauseous vapor or odor or which causes an undue amount of smoke.
Except for § 71-2D, it shall be unlawful for any person or persons to cause, suffer or maintain any fire within the Borough of West Conshohocken without first receiving a permit from the West Conshohocken Fire Marshal.

Any person violating the provisions of this chapter shall be subject to the provisions detailed in Chapter 53A of the Code of the Borough of West Conshohocken.
