Whenever any police officer, fire fighter, crash rescue crew person, fire marshal, chief deputy fire marshal, or deputy fire marshal of the Town of Smithfield shall be wholly or partially incapacitated by reason of injuries received or sickness contracted in the performance of his or her duties, the Town of Smithfield shall pay to said individual, as a retirement disability allowance, 66 2/3% of that individual's annual salary at the time of retirement.

Retirement disability payments made under the provisions of § 87-1 of this Code are paid pursuant to the requirements of General Laws of Rhode Island, §§ 45-19-1 and 45-19-19, which provide for compensation to certain employees injured in the course of employment. To the maximum degree permitted by law, said disability payments are to be excluded from the recipient s gross income for the purposes of taxation.
